Abstract
Pemilihan judul tersebut dilatarbelakangi oleh dikeluarkannya Keputusan Menteri Ketenagakerjaan Republik Indonesia Nomor 260 Tahun 2015 Tentang Penghentian dan Pelarangan Penempatan Tenaga Kerja Indonesia Pada Pengguna Perseorangan Di Negara-Negara Kawasan Timur Tengah. Di dalam keputusan tersebut menjelaskan bahwasanya Indonesia melarang adanya penempatan TKI di 19 negara kawasan Timur Tengah. Dalam hal pelarangan penempatan TKI sudah diatur dalam sebuah Undang-Undang Nomor 39 Tahun 2004 Tentang Penempatan Dan Perlindungan Tenaga Kerja Indonesia Di Luar Negeri, dalam pasal 27 ayat (1) menjelaskan bahwa penempatan TKI di luar negeri dapat dilakukan ke negara tujuan yang pemerintahannya telah membuat perjanjian tertulis dengan pemerintah negara penempatan. Peneliti melakukan analisis terkait pemberlakuan kebijakan moratorium terhadap TKI yang hendak berangkat ke negara Arab Saudi. Berdasarkan hal tersebut peneliti mengangkat rumusan masalah yaitu Bagaimana kebijakan pengaturan moratorium TKI yang pernah diberlakukan di negara Kuwait dan Malaysia Dan Bagaimana Analisis Keberlakuan kebijakan moratorium Profesi Penata Laksana Rumah Tangga di Arab Saudi Kaitannya Dengan Kesempatan Mendapatkan Pekerjaan Bagi WNI. Penelitian ini adalah penelitian yuridis normatif dengan menggunakan pendekatan perundang-undangan dan pendekatan perbandingan. Adapun bahan hukum yang digunakan yakni bahan hukum primer yaitu peraturan perundang-undangan, bahan hukum sekunder meliputi literatur-literatur terkait Kebijakan Moratorium, dan kamus yang diperlukan. Teknik analisis bahan hukum memakai interpretasi sistematis dan komparatif. Dari hasil penelitian dan analisi sesuai dengan metode diatas, maka peneliti memperoleh hasil penelitian dan jawaban dari rumusan masalah yang dikemukakan yakni: dalam hal ini peneliti berpendapat bahwa keberlakukan kebijakan moratorium untuk negara Kuwait dan Malaysia telah sesuai dengan peraturan yang mengatur adanya moratorium. MoU negara antara Pemerintah Indonesia dengan Kuwait tidak menjelaskan mengenai perlindungan TKI melainkan hanya menjelaskan mengenai penempatan TKI di Kuwait. Sedangkan Untuk Malaysia juga demikian, dalam MoU tersebut menjelaskan bahwasanya dokumen TKI dipegang oleh Majikan. Namun, setelah adanya perubahan, pemerintah mencabut adanya moratoium ke negara Malaysia. Sedangkan untuk Keberlakuan moratorium TKI tidak sesuai dengan peraturan-peraturan tentang penghentian TKI tersebut, serta negara Arab Saudi dan Pemerintah Indonesia telah memiliki MoU yang menjelaskan tentang perlindungan TKI.
English Abstract
The election of the title is motivated by the issuance of the Decree of the Minister of Manpower of the Republic of Indonesia Number 260 of 2015 on Termination and Prohibition of the Placement of Indonesian Migrant Workers in Individual Users In the Middle East Countries. In the decree explained that Indonesia prohibits the placement of labor migrants in 19 countries of the Middle East region. In the case of prohibition of placement of migrant workers has been regulated in a Law Number 39 Year 2004 on the Placement and Protection of Indonesian Overseas Workers, in Article 27 paragraph (1) explains that the placement of migrant workers abroad can be done to the destination country whose government has made written agreement with the placement state government. Researchers conducted an analysis related to the enforcement of moratorium policy against migrant workers who want to leave for Saudi Arabia. Based on this the researcher raised the problem formulation that is how the regulation policy of moratorium TKI ever applied in the country of Kuwait and Malaysia And How Analysis of the implementation of policy of moratorium of profession of helper in Saudi Arabia relation with opportunity to get work for citizen. This research is normative juridical research using approach of legislation and comparative approach. The legal material used is the primary legal material that is the legislation, secondary legal material covers the related literature Moratorium Policy, and the dictionary required. The technique of analysis of legal materials uses a systematic and comparative interpretation. From the results of research and analysis in accordance with the above methods, the researchers obtained the results of research and answers from the formulation of the problem proposed namely: in this case researchers argue that the moratorium policy to apply for the state of Kuwait and Malaysia has been in accordance with the rules governing the moratorium. The MoU between the Government of Indonesia and Kuwait does not explain the protection of labor migrants but only explains the placement of labor migrants in Kuwait. As for Malaysia, too, the MoU explains that the documents of TKI are held by the Employer. However, after the change, the government lifted the moratoium to Malaysia. As for the enforcement of moratorium TKI not in accordance with the regulations on the termination of migrant workers, as well as the state of Saudi Arabia and the Government of Indonesia has a MoU that explains about the protection of labor migrants.
