Abstract
Penerapanpasal 18 ayat (1) huruf b UndangundangPemberantasanTindakPidanaKorupsitetangpidanatambahanpembayaranuangpenggantime nimbulkaninkonsistensiatauketidaktepatanapakahpasal 18 ayat (1) huruf b tentangpidanatambahanuangpenggantiiniditerapkankedalampasalundangundangpemberantasantindakpidanakorupsi yang hanyamenimbulkankerugiankeuangannegaraataudapatditerapkankeseluruhpasaldalamundangundangpemberantasantindakpidanakorupsi. Di masa yang akandatangpenulisberharap agar pasal 18 ayat (1) huruf b initentangpidanatambahanpembayaranuangpenggantidapatdirevisidenganaturan yang lebihterperinci, tidakmultitafsir, sertamengaturdenganpastipenerapanpidanatambahanpembayaranuangpenggantiinisehinggapeneg akkanhukumtindakpidanakorupsidapatlebih optimal danjugaakanterwujudnyatujuansertahakekathukum yang sebenarnya.
English Abstract
The application of Article 18 paragraph (1) Sub-Paragraph b of the Anti-Corruption Law of the Criminal Court of addition to the payment of replacement money resulted in inconsistency or inaccuracy of whether Article 18 paragraph (1) Sub-Paragraph b regarding the additional penalty of this substitute shall be applied in the act of eliminating acts criminal corruption that only causes a state financial loss or can be applied to all articles in the anti-corruption law. In the future, the authors hope that Article 18 Paragraph (1) Sub-Paragraph b shall refer to the additional penalty of replacement payments may be revised with more detailed rules, not multiple interpretations, and clearly regulate the application of additional criminal payment of this substitute money so that the enforcement of criminal law corruption can be more optimal and will also realize the real purpose and nature of law.
