Abstract
Penelitian ini, penulis mengangkat permasalahan Legalitas Renegosiasi Kontrak Karya Mineral dan Batubara Ditinjau Dari Asas Keseimbangan Kontrak. Pemilihan judul tersebut dilatarbelakangi oleh adanya benturan kepentingan dari pihak pertama yaitu Pemerintah Indonesia yang berkedudukan menjalankan kepentingan publik dengan pihak kedua yaitu Investor Asing yang berkedudukan menjalankan tujuan bisnisnya (privat), dimana pihak pertama melakukan negosiasi ulang kontrak karya dengan pihak kedua dengan berlandasan hukum Pasal 169 huruf b Undang-Undang Nomor 4 Tahun 2009 tantang Pertambangan Mineral dan Batubara. Berdasarkan hal tersebut, penulis mengangkat rumusan masalah yaitu Bagaimana legalitas renegosiasi kontrak karya mineral dan barubara ditinjau dari asas kesimbangan kontrak? Penulisan skripsi ini menggunakan metode Yuridis-Normatif dengan pendekatan Undang-Undang (Statute Approach), bahan hukum primer yang digunakan penulis meliputi Kitab Undang-Undang Hukum Perdata, Undang-Undang Nomr 4 Tahun 2009, dan UNIDROIT Principles of International Commercial Contract. Teknik analisis dalam penelitian ini menggunakan metode interpretasi hermeneutik. Berdasarkan pembahasan, maka dapat disimpulkan tindakan pemerintah melakukan renegosiasi kontrak karya mineral dan batubara ditinjau dari asas keseimbangan kontrak adalah legal, tambahan dasar hukum dalam renegosiasi kontrak bisnis internasional tersebut pemerintah saat ini didukung oleh asas proporsionalitas, prinsip hardship, dan prinsip kedaulatan permanen atas kekayaan sumber daya alam.
English Abstract
This research, the author electing the issue of The Legality of Renegotiation Minerals and Coal Contract of Work Reviewed from equilibrium contract principle. This research based on the conflict between the first party, which is Indonesia government’s interest as a public order with the second part, which is foreign investment’s business interest (private), where the first party doing the renegotiate of work contract based on article 169 letter b law number 4 year 2009 about Minerals and Coal Mining Based on that, the author raised the formulation of the problem is how the legality of renegotiation minerals and coal contract of work reviewed from equilibrium contract principle? Writing this thesis is using Juridical-Normative method with statute approach. Primary material law that tae author use such as code of civil law, law number 4 year 2009 about Minerals and Coal Mining, and UNIDROIT Principle of International Commercial Contract. Analytical techniques this research using hermeneutical method. Based on the results, the conclusion is the government's action to renegotiate the contract of work of minerals and coal reviewed from equilibrium contract principle is legal, and the additional legal basis in the renegotiation of international business contracts, the government is currently supported by the principle of proportionality, hardship principle, and the principle of permanent sovereignty over natural resources.
