English Abstract
The general aim of this research is to describe factors that govern the choice of actions in settling land dispute in the community and the meaning of dispute settlement in the state court. The specific aim is to develop a theoretical notion based on the field data on the function of state court as an institution in settling dispute in the community. The research method employed is case studies. Data gathering is done through observation, interviews and documentation. The qualitative data is inductively interpreted and then a theory is built based on the field data. The result of the research showed that habit, family relationship, avoiding enmity (culture), considering profit and loss (economy) and compulsion (situation) influence the people involved in the dispute whether or not to use the state court to settle their dispute. Dispute settlement in state court implies enmity, high cost and time consumption. Dispute settlement in state court is, however, effective through its decision in judging who has the right upon the land being disputed. In this context, the theory stating that culture is a significant factor in deciding whether or not to use court to settle dispute has some defects. Based on the results of this research, a theory is built then and states as follows: Culture, economy, and situation influence someone' s choice of action to use or not to use the law (state court)in settling a dispute
