Abstract
Pasal 44 huruf D yang berbunyi “perusahaan Angkutan Umum sebagaimana dimaksud dalam Pasal 37 ayat (1), wajib; mempekerjakan pengemudi yang telah memiliki Surat Izin Mengemudi (SIM) Umum sesuai dengan golongannya.”Pada kenyataannya sebagian besar pengemudi transportasi online hanya memiliki Surat Ijin Mengemudi (SIM) kendaraan bermotor perseorangan dan tidak memiliki SIM kendaraan bermotor Umum. Permasalahan dalam penelitian ini terkait implementasi Pasal 44 huruf d Peraturan Menteri Perhubungan Republik Indonesia Nomor 108 Tahun 2017 Tentang Penyelenggaraan Angkutan Orang dengan Kendaraan Bermotor Umum Tidak dalam Trayek terkait penggunaan aplikasi berbasis tekonologi informasi di Kota Malang, dan kendala dalam implementasi Pasal 44 huruf d Peraturan Menteri Perhubungan Nomor 108 Tahun 2017 tersebut agar dapat berjalan dengan efisien, khususnya di kalangan pengemudi taksi online. Penelitian ini menggunakan metode penelitian yuridis normatif, pendekatan penelitian yuridis sosiologis, data primer berupa wawancara dengan pengemudi dan pemilik perusahaan jasa taksi onlinedi Kota Malang serta data sekunder berupa dokumen yang terdiri dari arsip, laporan, notulensi, risalah, perjanjian dan lain – lain yang berhubungan dengan ketentuan Pasal 44 huruf d Peraturan Menteri Perhubungan Republik Indonesia Nomor 108 Tahun 2017 Tentang Penyelenggaraan Angkutan Orang, serta dianalisis dengan teknik analisis bahan hukum deskriptif analisis guna menganalisis permasalahan dalam penelitian ini. vi Hasil penelitian ini menunjukkan bahwa implementasi Pasal 44 huruf d Peraturan Menteri Perhubungan Republik Indonesia Nomor 108 Tahun 2017 Tentang Penyelenggaraan Angkutan Orang dengan Kendaraan Bermotor Umum Tidak dalam Trayek terkait penggunaan aplikasi berbasis tekonologi informasi di Kota Malang khususnya terhadap status kepemilikan SIM A Umum adalah dengan memenuhi syarat umur dan syarat administrasi untuk mendapatkan SIM A Umum.Hambatan yang terjadi adalah tidak adanya aturan hukum yang menunjang keberlakuan dari taksi online, tidak adanya koordinasi dengan pihak kepolisian dalam pengawasan yang dilakukan terhadap transportasi online, dan banyaknya penyedia jasa transportasi online yang berstatus sebagai perusahaan penyedia aplikasi bukan sebagai perusahaan transportasi.Sedangkan upaya yang dilakukan adalah menghimbau pengemudi taksi online dengan mengganti dan mengantongi status SIM A golongan umum, melakukan sosialisasi dan seminar-seminar, sosialisasi dan seminar ini dimaksudkan agar mendorong konsumen untuk memahami hak dan kewajiban para driver online, dan dengan melakukan himbauan kepada penyedia jasa transportasi online yang masih berstatus sebagai perusahaan penyedia aplikasi untuk mengubah statusnya menjadi perusahaan transportasi.
English Abstract
Article 44 letter D which reads "Public Transport Company as referred to Article 37 paragraph (1), is obligatory; hire drivers who already have a General Driving License (SIM) in accordance with their class”. In fact, most online transportation drivers only havepersonal driver's license (SIM) and do not have public motorized driver's license. The problems in this study is related to the implementation of Article 44 letter d of the Minister of Transportation Regulation of the Republic of Indonesia Number 108 of 2017 on the Implementation of Public Transport of Vehicles Not in the Route related to the use of information technology-based applications in Malang City, and constraints tocarry out Article 44 letter d of Ministerial Regulation Transportation No. 108 of 2017 to be run efficiently, especially among online taxi drivers. This study used a normative juridical research method, a sociological juridical research approach, primary data in the form of interviews with drivers and owners of online taxi service companies in Malang City as well as secondary data in the form of documents consisting of archives, reports, minutes, treatise, agreements and others that related to the provisions of Article 44 letter d of the Minister of Transportation Regulation of the Republic of Indonesia Number 108 of 2017 about Managing Transportation, and using descriptive technique of legal material to analyze the problems in this study. The results of this study show that the implementation of Article 44 letter d of the Minister of Transportation Regulation of the Republic of Indonesia Number 108 of 2017 Concerning the Implementation of People's Transportation viii with Public Vehicles not in Route related to the use of information technologybased applications in Malang City, especially on General A SIM ownership status is to fulfill the administrativeand age requirements to get a General A SIM. Constraints that occur are the absence of legal rules that support the online taxisenforceability, lack of coordination with the police in the supervision on online transportation, and the number online transportation service providers that only have application provider companies’ status, not a transportation companies. While the efforts made to appeal online taxi drivers to replace and get the status of general A SIM, conducting socialization and seminars in order to encourage consumers to understand the rights and obligations of online drivers, and by appealing to online transportation service providers that still have status asan application provider company to change its status to a transportation company.
