Abstract
Pada skripsi ini, peneliti membahas permasalahan PENERAPAN PASAL 32 UNDANG-UNDANG NOMOR 3 TAHUN 1982 TENTANG WAJIB DAFTAR PERUSAHAAN (Studi di Dinas Penanaman Modal dan Pelayanan Terpadu Satu Pintu Kota Banjarmasin). Untuk mengetahui bagaimanakah penerapan Pasal 32 Undang-Undang Nomor 3 Tahun 1982 tentang Wajib Daftar Perusahaan di Kota Banjarmasin. Penelitian ini bertujuan untuk untuk mengidentifikasi, mendeskripsikan dan menganalisis Penerapan Pasal 32 Undang-Undang Nomor 3 Tahun 1982 tentang Wajib Daftar Perusahaan terhadap perusahaan yang dengan sengaja atau melalaikan Tanda Daftar Perusahaan di Kota Banjarmasin dan kendala serta upaya dalam penerapannya. Berdasarkan hal tersebut Peneliti tertarik untuk melakukan penelitian tentang Penerapan Pasal 32 Undang-Undang Nomor 3 Tahun 1982 tentang Wajib Daftar Perusahaan di Kota Banjarmasin, dengan penggunaan metode penelitian yuridis empiris dengan metode pendekatan yuridis sosiologis. Lokasi penelitian dilakukan di Dinas Penanaman Modal dan Pelayanan Terpadu Satu Pintu Kota Banjarmasin. dari hasil penelitian dengan metode diatas, Peneliti memperoleh jawaban atas permasalahan yang ada mengenai Penerapan Pasal 32 Undang-Undang Nomor 3 Tahun 1982 tentang Wajib Daftar Perusahaan di Kota Banjarmasin dipengaruhi oleh 3 (tiga) faktor antara lain Faktor Substansi Hukum, Faktor Sturktur Hukum dan Faktor Budaya Hukum. Berdasarkan penelitian yang telah dilakukan, diperoleh kesimpulan bahwa Penerapan Pasal 32 Undang-Undang Nomor 3 Tahun 1982 tentang Wajib Daftar Perusahaan dapat berjalan dengan efektif apabila dari faktor subtansi hukum membuat Peraturan Daerah atau Peraturan Walikota mengenai Wajib Daftar Perusahaan, dari faktor Struktur Hukum tersedianya Penyidik Pegawai Negeri Sipil Wajib Daftar Perusahaan (PPNS WDP) di Kota Banjarmasin, dan dari faktor Budaya Hukum kesadaran diri dari masyarakat atau pelaku usaha untuk taat ada aturan-aturan yang berlaku.
English Abstract
In this skripsi, the researcher discusses the problem of APPLICATION OF ARTICLE 32 LAW NUMBER 3 OF 1982 CONCERNING COMPANY REGISTRATION REQUIREMENTS (Study in Banjarmasin Investment and One Stop Service). To find out how the application of Article 32 of Law Number 3 of 1982 concerning Obligatory Registration of Companies in Banjarmasin City. This study aims to identify, describe and analyze the Application of Article 32 of Law Number 3 of 1982 concerning Corporate Registration for companies that intentionally or neglect Company Registration in Banjarmasin and constraints and efforts in their implementation. Based on this, the researcher was interested in conducting research on the Application of Article 32 of Law Number 3 of 1982 concerning Obligatory Registration of Companies in the City of Banjarmasin, with the use of empirical juridical research methods with a sociological juridical approach method. The location of the study was carried out at the Banjarmasin City Investment and Integrated Services Office. from the results of the research with the method above, the researcher obtained answers to the existing problems regarding the Application of Article 32 of Law Number 3 of 1982 concerning the Obligatory Registration of Companies in the City of Banjarmasin influenced by 3 (three) factors including Legal Substance Factors, Legal Sturc Factors and Factors Legal Culture. Based on the research that has been done, it can be concluded that the Application of Article 32 of Law Number 3 of 1982 concerning Compulsory Corporate Registration can be effective if the legal substance factor makes a Regional Regulation or Mayor's Regulation concerning the Obligatory Registration of Companies, from the Legal Structure of the availability of Employee Investigators Civil Registration Obligatory Company (PPNS WDP) in Banjarmasin City, and from Cultural Law Legal self-awareness from the community or business actors to obey existing rules.
