Abstract

Pada skripsi ini penulis mengangkat mengenai implikasi hukum bagi Korea Utara terhadap peristiwa uji coba peluncuran rudal yang terjadi pada 27 Agustus 2017, melintasi pulau ujung utara Jepang Hokkaido dan jatuh di Samudra Pasifik. Berdasarkan hal tersebut diatas, karya tulis ini mengangkat rumusan masalah (1) Apakah uji coba rudal Korea Utara dapat dikatakan sebagai pelanggaran kedaulatan Negara Jepang? (2) Apa implikasi hukum bagi Korea Utara terhadap peristiwa peluncuran rudal yang melintasi wilayah Jepang? Kemudian penulisan karya tulis ini menggunakan metode yuridis normatif. Penelitian yuridis normatif adalah penelitian hukum dengan metode penelitian bahan pustaka atau data sekunder sebagai bahan dasar untuk diteliti dengan cara mengadakan penelusuran terhadap peraturan-peraturan serta literatur-literatur yang berkaitan dengan permasalahan yang sedang diteliti. Mengingat kedaulatan negara adalah kekuasaan tertinggi yang dimiliki sebuah negara, tindakan Korea Utara tersebut dapat dikatakan melanggar wilayah kedaulatan Jepang dengan didukung teori-teori kedaulatan negara di udara, salah satunya The National Security and Efectiv Control Theory. Disamping itu ada perjanjian yang membatasi setiap negara untuk memiliki senjata nuklir yaitu Non Poliferation Nuclear Treaty (NPT), dan karena itu Dewan Keamanan PBB beberapa kali mengeluarkan resolusi untuk Korea Utara namun sepertinya tetap kurang efektif, seharusnya DK PBB menjatuhkan yang sanksi lebih berat agar Korea Utara bisa mempunyai efek jera.

English Abstract

In this major thesis, the author raised about the legal implications for North Korea against test-launch a missile incident that occurred on August 27th, 2017, crossing the northern Japanese island of Hokkaido and crashed in the Pacific Ocean. Based on the incident, this research raised the formulation of problem (1) Is the North Korean missile tests can be considered as a violation of sovereignty of Japan? (2) What are the legal implications for North Korea against missile launch events across the region Japan? The writing of this research use normative juridical method. Normative research is legal research with the research methods of literature or secondary data as the base material to be tested by conducting a search for rules and literature relating to the cases being studied. Given the country's sovereignty is the supreme power of a nation, North Korea's actions can be said to violate the territorial sovereignty of Japan supported the theories of state sovereignty in the air, one of the National Security and Effective Control Theory. Besides, there is agreement that limits each country to have a nuclear weapon i.e Non Poliferation Nuclear Treaty (NPT), and therefore the UN Security Council several times passed a resolution on North Korea, but it apparently still less effective, supposedly the UN Security Council impose sanction more strictly in order to North Korea could give a deterrent effect.
