Abstract
Pemutaran lagu yang diumumkan ke publik merupakan bentuk dari pengumuman karya fonogram yang diumumkan secara komersial sebagaimana termaktub dalam Pasal 24 ayat (4) dan Pasal 27 UU No. 28 Tahun 2014 tentang Hak Cipta sehingga bagi pemutar lagu secara komersial dapat dikenakan royalti atas hak terkait, penerapan ketentuan pasal tersebut dapat menjadi problematika penerapan hukum bagi pihak-pihak atau pelaku usaha yang selalu memutarkan lagu untuk sarana pelengkap atau hiburan di tempat usaha tersebut, seperti café dan restaurant. Problematika terhadap pelaksanaan Pasal 24 ayat (4) UU Hak Cipta menjadi fokus kajian dan penulis untuk mengkaji permasalahan terkait pelaksanaan Pasal 2 ayat (4) UU Hak Cipta terhadap pengumuman karya cipta lagu secara komersial di restaurant atau cafe dan upaya yang dapat dilakukan untuk mengatasi sengketa pengumuman karya cipta lagu di cafe dan restaurant, untuk menjawab permasalahan tersebut penulis menggunakan pendekatan penelitian yuridis empiris di cafe dan restaurant, Lembaga Manajemen Kolektif Nasional, dan Produser rekaman di DKI Jakarta, sebab pertumbuhan teknologi, tempat hiburan di DKI Jakarta berkembang pesat sebagai ibu kota negara dan kota metropolitan. Berdasarkan hasil penelitian langsung dan analisa yuridis diperoleh bahwa produser rekaman tidak menjadikan pemutaran lagu di café atau restaurant sebagai fokus atau objek pengawasan, sedangkan Lembaga Manajemen Kolektif Nasional mengalami kesulitan dalam pengawasan dan pemungutan royalti sampai ke daerah, sebaliknya semua pihak cafe atau restaurant yang menjadi objek penelitian tidak tahu bahwa pemutaran lagu yang biasa mereka putar di jam operasional dikenai royalti dengan perhitungan yang disamakan yakni berdasarkan jumlah kursi, sehingga menimbulkan keberatan bagi pihak cafe atau restaurant. Oleh karena itu, penulis merumuskan upaya yang dapat dilakukan bagi produser rekaman dengan menyusun rencana untuk mengontrol pemutaran lagu di cafe atau restaurant, bagi Lembaga Manajemen Kolektif Nasional diperlukan penataan SDM di daerah atau memperkuat koordinasi dengan instansi terkait, sedangkan bagi pihak café atau restaurant dapat mengajukan uji peraturan, keberatan ke Lembaga Manajemen Kolektif Nasional, dan membentuk perkumpulan untuk mempermudah penampungan aspirasi dan terorganisir. Upaya preventif diperlukan terhadap Lembaga Manajemen Kolektif Nasional untuk memberikan sosialisasi kepada pihak café atau restaurant, sedangkan apabila terdapat sengketa atau pelanggarannya dapat diajukan klarifikasi, somasi bahkan sampai jalur litigasi.
English Abstract
Playing music in public is categorised into an act of announcing phonogram for commercial purpose as stipulated in Article 24 Paragraph (4) and Article 27 of Law Number 28 Year 2014 on Copyright. It implies that whoever plays music for commercial purpose should be charged for a royalty. The implementation of this article is problematic in the application of law for parties and entrepreneurs who play music for entertainment to support their business in places like cafés and restaurants. The problem related to the implementation of Article 24 Paragraph (4) of Law on Copyright has been the focus for this study which also contributes to studying Article 2 Paragraph (4) of Law on Copyright regarding music played in public such as in cafés and restaurants for commercial purpose. This research is also focused on attempts done to settle any dispute related to announcement of music work in cafés and restaurants. To give answers to the problems, empirical juridical approach was employed in this research, and it was conducted in cafés and restaurants, National Collective Management, and record company in Jakarta since technology and nightclubs in Jakarta have been growing rapidly a part of metropolitan city. Based on the research result and juridical analysis, it is implied that the act of playing music for commercial purpose in cafes and restaurants is not the focus and supervision of National Collective Management since this organisation has difficult time supervising and charging for royalty up to regional level, while entrepreneurs running café and restaurant business are not aware that playing music for entertainment is considered having commercial purpose and thus it may charge them some amount of money for royalty that has to be paid based on the numbers of chairs. Those involved in the business are surely reluctant to comply with the policy. Therefore, there are some measures, as suggested by the author, that record company could take by planning some steps to control the music playing in cafés and restaurants. For National Collective Management, improving human resource at regional level and coordination with related institutions is required, and cafés and restaurants are able to propose regulation test or objection to National Collective Management and establish a team for a better way of organizing and managing aspiration. Moreover, preventive action also needs to be taken by National Collective Management by raising awareness of those involved in café and restaurant business. Any dispute and infringement could be clarified or could be responded with a legal notice or such a situation could even take litigation.
