Abstract
Dalam penulisan skripsi ini penulis membahas tentang efektivitas Udang-Udangan Nomor 11 Tahun 2010 Tentang Cagar Budaya Di Kota Malang, Hal ini dilatar belakangi dengan adanya Undang-Undang Tentang Cagar Budaya Pasal 95 Ayat (1) dan Ayat (2) Huruf (b), namun pada kenyataannya masih banyaknya Bangunan Cagar Budaya yang belum mendapatkan perlindungan, pengembangan dan pemanfaatan dimana seharusnya Pemerintah yang dalam hal ini di wakili oleh Dinas Kebudayaan melindungi dan menjaga Bangunan Cagar Budaya yang ada di Kota Malang. Permasalahan yang dikaji dalam penelitian ini meliputi bagaimana Efektivitas Pasal 95 Ayat (1) dan (2) Huruf (b) Undang-Undang Nomor 11 Tahun 2010 Tentang Cagar Budaya di Kota Malang dan bagaimana upaya pemerintah daerah Kota Malang, Komunits Pelestari dan Pemerhati sejarah heritage dalam mengembangkan dan menerapkan kebijakan yang dapat menjamin terlindunginya dan termanfaatkannya Bangunan Cagar Budaya di Kota Malang. Untuk mengetahui permasalahan yang ada maka metode pendekatan yang digunakan adalah metode pendekatan yuridis sosiologis. Berdasarkan hasil penelitian, penulis memperoleh jawaban atas permasalahan yang ada, bahwa dalam penerapan pasal tersebut terkait bangunan cagar budaya belum berjalan dengan efektif. Hal ini dikarenakan belum adanya peraturan daerah yang mengatur secara Khusus, kurangnya kesadaran masyarakat, minimnya anggaran dana yang dimiliki, kurangnya kordinasi antara Dinas Kebudayaan dan Pariwsata Kota Malang dengan Dinas Perizinan terkait pemberian izin.
English Abstract
In this mini-thesis (skripsi), the author discusses about the effectiveness of the Law Number 11 Year 2010 on Cultural Conservation in Malang City. This is motivated by the existence of Article 95 paragraph (1) and (2) letter (b) of the Law on Cultural Conservation, but in fact, there are many cultural conservation buildings do not get protection, development, and utilization from the Department of Culture and Tourism of Malang City for protecting and maintaining cultural conservation buildings which is located in Malang City. The issues that are examined in this research, namely how is the effectiveness of Article 95 paragraph (1) and (2) letter (b) of the Law Number 11 Year 2010 on Cultural Conservation in Malang City? andhow are the efforts of the local government of Malang City,preservation communities, and historical heritage observers in order to develop and implement the rules that can guarantee the protection and the utilization of cultural conservation buildingsin Malang City. In order to understand the existing problems, so the research approach that is used, namely sociological jurisprudence method. Based on the result of the research, the author found the answer on the existing problems that in the implementation of those articles related to cultural conservation buildings is still not effective enough. It is due to the absence of specific local regulations, the lack of awareness from society, the lack of funding, the minimum of coordination between Department of Culture and Tourism of Malang City and Permit Agency related to giving permission.
