Abstract
Pada skripsi ini, penulis mengangkat permasalahan penggunaan hak veto oleh Rusia dalam konflik bersenjata di Suriah. Pilihan judul ini dilatar belakangi oleh tidak sesuainya penggunaan hak veto berdasarkan pasal 27 (3) Piagam Perserikatan Bangsa-bangsa (PBB). Terkait permasalahan ini, ternyata Dewan Keamanan PBB sama sekali tidak bisa melakukan atau menjalankan resolusinya karena terpengaruh adanya veto yang dikeluarkan oleh Rusia. Berdasarkan hal tesebut, sehingga skripsi ini mengangkat rumusan masalah sebagai berikut : (1) Apakah penggunaan hak veto oleh Rusia dalam konflik bersenjata di Suriah sudah sesuai dengan pasal 27 (3) Piagam PBB. (2) Apa latarbelakang penggunaan hak veto oleh Rusia dalam konflik bersenjata di Suriah. Selanjutnya dalam penulisan skripsi ini, menggunakan metode yuridis normatif dengan pendekatan peraturan hukum tertulis (statute approach), pendekatan kasus (case approach) dan pendekatan konseptual (conseptual approach). Bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier penulis analisis menggunakan metode deskriptif analitis yaitu, dengan cara menganalisa makna dari konvensi internasional maupun pendapat dari beberapa ahli hukum internasional. Dengan demikian, hasil akhir penelitian penulis menemukan jawaban diatas, bahwa penggunaan hak veto Rusia tidak sesuai dengan pasal 27 (3) Piagam PBB dan tidak tercantum aturan terkait penggunaan hak veto. Selain itu penggunaan hak veto bertentangan dengan asas-asas hukum internasional. Penggunaan hak veto dilatar belakangi dengan alasan-alasan politis. Sehingga menjadikan beberapa draft resolusi Dewan Keamanan PBB tidak bisa diimplementasikan.
English Abstract
In this paper, the author raises the question of the use of veto by Russia in armed conflict in Syria. This title option is grounded by the inappropriate use of veto rights under article 27 (3) of the United Nations Charter. Related to this problem, it turns out the UN Security Council could not do or carry out its resolution because it affected the existence of a veto issued by Russia. Based on these matters, this thesis raises the following issues: (1) Whether the use of veto by Russia in armed conflict in Syria is in accordance with article 27 (3) of the UN Charter. (2) What is the background of the use of veto by Russia in armed conflict in Syria. Furthermore, in writing this thesis, using normative juridical method with the approach of statutory law (statute approach), case approach (case approach) and conceptual approach (conseptual approach). The primary legal materials, secondary legal materials and tertiary legal materials of analytical writers use descriptive analytical methods that is, by analyzing the meaning of international conventions as well as the opinions of some international jurists. Thus, the final result of the study finds that the use of Russian veto is incompatible with article 27 (3) of the Charter of the United Nations and does not contain any rules regarding the use of veto rights. In addition, the use of veto is against the principles of international law. The use of veto rights is based on political reasons. Thus making several drafts of UN Security Council resolutions can not be implemented.
