Abstract
Efektivitas SE direktur jendral minerba No 04,E/30/DJB/2015 tentang penyelenggaraan urusan pemerintah di bidang pertambangan mineral dan batubara terkait dengan pengeluaran izin penambangan pasir di aliran sungai kantong lahar gunung kelud yang berada di Kabupaten Blitar yang mana angka 5 di dalam surat edaran ini menjelaskan bahwa gubernur harus segera menetapkan WPR yang sudah diajukan oleh kabupaten belum efektif . dlilihat dari belum ada atau belum turun rekomendasi dari pemerintah pusat maupun pihak provinsi Jawa Timur sendiri terkait penetapan WPR sendiri untuk Kabupaten Blitar disini diwakilkan oleh pihak dinas ESDM. Penetapan izin yang belum ada regulasinya akan menimbulkan permasalahan secara vertikal antara masyarakat sekitar tambang dengan pemerintah daerah maupun pusat yang seakan enggan untuk mengurusinya.
English Abstract
The effectiveness of the Director General of Coal and Minerals Circular Letter No. 04.e/30/djb/2015 on the Management of Government Matters in the Field of Minerals and Coal Mining related to the issuance of sand mining permit in river basin of the bag lava of Kelud Mountain which is located in Blitar Regency that in Number 5 of this Circular Letter explains that Governor should immediately issue WPR submitted by Regency which is not effective. It can be seen from the absence of recommendation from central government and provincial government of East Java related to the implementation of WPR for Blitar Regency which is represented by the Energy and Mineral Resources Agency. The issuance of permit that the regulation does not exist will cause problems vertically between societies around the mining areas and local government as well as central government which they are seems unwilling to do it.
