Abstract
Perkembangan pada dunia teknologi informasi berpaduan dengan sektor jasa keuangan melahirkan suatu inovasi baru yang disebut Financial Technology atau Fintech. Salah satu produk yang ditawarkan oleh Fintech yaitu Peer-to-peer Lending merupakan suatu solusi alternatif layanan pinjam-meminjam yang berbasis online. Kehadiran peer-to-peer lending dilatarbelakangi dengan cara membuka akses keuangan yang dapat mendukung pertumbuhan ekonomi nasional berkelanjutan dan meningkatkan inklusi keuangan di Indonesia. Hal ini disebabkan pada kenyataannya tidak seluruh masyarakat dapat mengakses dan menikmati jasa perbankan atau unbanked. Dengan demikian adanya kehadiran peran peer-to-peer lending sangat bermanfaat bagi masyarakat dalam rangka memberikan pinjaman dana baik untuk usaha UMKM atau individu serta berfungsi sebagai alternatif instrumen investasi bagi para pemberi pinjaman. Penelitian ini bertujuan untuk menganalisis perlindungan hukum bagi pemberi pinjaman dalam kegiatan layanan peer-to-peer lending menurut hukum positif di Indonesia. Jenis penelitian ini merupakan penelitian hukum normatif dengan menggunakan metode pendekatan perundang-undangan, historis dan analisis. Berdasarkan hasil dari penilitian, maka dapat menunjukkan bentuk perlindungan hukum yang dapat diberikan kepada pemberi pinjaman dalam kegiatan layanan peer-to-peer lending berupa perlindungan preventif dan represif sesuai dengan ketentuan peraturan perundang-undangan menurut hukum positif di Indonesia.
English Abstract
The simultaneous growth of information technology and finance services sector has created a brand new innovation known as Financial Technology or Fintech. One of the products offered by this technology is peer-to-peer lending, an alternative solution that supports online-based lending services. The existence of peer-to-peer lending is based on the way financial access is opened which could support the sustainable growth of national economy and increase the inclusion of finance in Indonesia. This is also supported by the fact that not all people in the country have access to banking systems or commonly known as unbanked. Therefore, it is concluded that the existence of peer-to-peer lending is considered very useful for the society in terms of lending services given to support Micro Small Medium Enterprises (UMKM) or individuals, and it is also useful for alternative instrument of investment for lenders. This research aims to analyse legal protection provided for lenders in giving peer-to-peer lending service according to positive law in Indonesia. This research is categorized into normative legal research with statute, historical, and analytical approach. Based on the research result, it can be said that legal protection can be provided for lenders in the form of either preventive or repressive protection as regulated in Laws according to positive law system in Indonesia
