Abstract
Peran Koperasi sangatlah penting dalam menumbuhkan dan mengembangkan potensi ekonomi rakyat. Sebagai badan usaha yang menjalankan kegiatan usaha simpan pinjam dan juga lembaga pembiayaan, terhadap Koperasi haruslah terdapat sebuah sistem pengawasan yang baik. Permasalahan terkait pelaksanaan pengawasan ini adalah implementasi Pasal 2 Dan Pasal 6 Ayat (3), hambatan-hambatan, serta upaya-upaya dalam mengatasi kendala tersebut. Berdasarkan latar belakang diatas, Tujuan dari penulisan ini untuk mengetahui dan menganalisis implementasi Pasal 2 dan Pasal 6 Ayat (3) Peraturan Menteri Koperasi Dan UKM Nomor 17/Per/M.KUKM/IX/2015 Tentang Pengawasan Koperasi terkait pengawasan pelaksanaan usaha simpan pinjam di Dinas Koperasi dan UKM Kota Malang dan kendala-kendala yang dihadapi dalam implementasi pengawasan koperasi, serta mengetahui dan menganalisis upaya-upaya dalam menghadapi kendala-kendala. Sedangkan metode penelitian yang digunakan adalah penelitian yuridis empiris, pendekatan yuridis sosiologis, jenis dan sumber data yang digunakan yaitu data primer dan data sekunder, teknik memperoleh data melalui wawancara, teknik analisis data yang digunakan adalah metode deskriptif kualitatif. Implementasi Pasal 2 dan Pasal 6 Ayat (3) Peraturan Menteri Koperasi Dan UKM Nomor 17/Per/M.KUKM/IX/2015 antara lain : dilakukannya kunjungan langsung atau inpeksi pada koperasi yang bersangkutan; pemeriksaan terhadap laporan Rapat Anggota Tahunan; dalam hal benar ditemukan permasalahan, maka akan dilakukan pengawasan oleh bidang penagwasan koperasi Dinas Koperasi dan Usaha Mikro Kota Malang untuk dicari penyebabnya; setelah ditemukan penyebab dari permasalahan yang dilakukan maka akan dilakukan pembinaan; pembinaan dilakukan pada koperasi yang bersangkutan dengan tujuan agar dapat dilakukan perbaikan.
English Abstract
The role of cooperatives is very important in growing and developing the economic potential of the people. As a business entity that runs savings and loan business activities as well as financing institutions, the Cooperative must have a good supervisory system. Issues related to the implementation of this supervision is the implementation of Article 2 and Article 6 Paragraph (3), constraints, as well as efforts to overcome these obstacles. Based on the above background, the purpose of this paper is to know and analyze the implementation of Article 2 and Article 6 Paragraph (3) Regulation of the Minister of Cooperatives and SME Number 17 / Per / M.KUKM / IX / 2015 About the supervision of Cooperatives related to supervision of the implementation of savings and loan business in Department of Cooperatives and SMEs of Malang City and the constraints faced in the implementation of cooperative supervision, as well as to know and analyze efforts in facing the constraints. While the research method used is empirical juridical research, sociological juridical approach, type and source of data used are primary data and secondary data, technique of obtaining data through interview, data analysis technique used is descriptive qualitative method. Implementation of Article 2 and Article 6 Paragraph (3) Regulation of the Minister of Cooperatives and SME Number 17 / Per / M.KUKM / IX / 2015, among others: direct visit or inpeksi on the cooperative concerned; examination of the Annual Members Meeting report; in the case of true found the problem, it will be supervised by the field pengagwasan cooperative Office of Cooperatives and Micro Enterprises Malang to look for the cause; after found the cause of the problems that will be done coaching; coaching is carried out on the cooperative concerned with the aim to make improvements
