Abstract
Pada penelitian ini penulis membahas mengenai Efektivitas Pasal 107 ayat (2) Undang - Undang nomor 22 tahun 2009 tentang Lalu Lintas dan Jalan terkait kewajiban menyalakan lampu utama pada siang hari atau Daytime Running Light (DRL) bagi pengendara sepeda motor di Kota Malang. Tujuan Penelitian ini untuk mengetahui efektivitas pasal 107 ayat (2) Undang - Undang Nomor 22 Tahun 2009 tentang Lalu Lintas dan Angkutan Jalan. Metode penelitian pada skripsi ini menggunakan jenis penelitian yuridis sosiologis dan menggunakan pendekatan konseptual (conceptual approach). Hasil penelitian ini ialah penerapan pasal 107 ayat (2) Undang - Undang nomor 22 tahun 2009 tentang Lalu Lintas dan Angkutan jalan di Kota Malang tidak berjalan efektif dikarenakan faktor masyarakat yang tidak memenuhi syarat efektifnya suatu peraturan, yaitu masyarakat mematuhi pasal tersebut bukan karena kesadarannya atau demi keselamatan diri sendiri maupun orang lain di jalan, melainkan karena takut diberi sanksi. Faktor lainnya yang membuat aturan ini tidak efektif adalah faktor pengak hukum yang tidak tegas dalam menindak para pelanggar aturan ini. Faktor berikutnya yang menyebabkan aturan ini tidak efektif ialah aturan hukum itu sendiri yang dianggap tidak tepat untuk di terapkan di Indonesia. Saran yang dapat diberikan oleh penulis melalui penelitian ini yakni, agar melakukan penjelasan lebih lanjut dalam pasal 107 ayat (2) Undang - Undang nomor 22 tahun 2009 tentang Lalu Lintas dan Angkutan Jalan mengenai kondisi tertentu pada siang hari seperti apakah sehingga mewajibkan pengendara sepeda motor menyalakan lampu utama.
English Abstract
In this research the author discusses the Effectiveness of Article 107 Section (2) Law Number 22 of 2009 on Traffic and Road Transportation related to the obligation to turn on the main light during the day or Daytime Running Light (DRL) for motorcyclists in Malang. The purpose of this research is to determine the effectiveness of Article 107 Section (2) Law Number 22 of 2009 on Traffic and Road Transportation. The research method in this thesis uses sociological juridical type of research along with conceptual approach. The result of this research shows that the application of article 107 paragraph (2) Law Number 22 of 2009 on Traffic and Road Transportation in the city of Malang is not effective because society does not fulfill the requirement in order for the regulation to be effective, considering that the society obeys the regulation not because of the awareness for their safety and others
