Abstract
Saat ini, terjadi invasi besar-besaran oleh kendaraan pribadi yang membutuhkan proporsi ruang yang cukup luas, menyebabkan kapasitas jalan semakin sempit dan berujung terjadinya kemacetan. Pada kenyataannya sampai saat ini pemerintah belum mampu mewujudkan moda transportasi umum yang nyaman dan aman bagi masyarakat. Masih banyaknya masyarakat yang tidak menyediakan garasi sesuai kendaraan yang dimilikinya, masih banyak masyarakat yang memarkir kendaraan di jalan lalu lalang kendaraan lain. Jenis penelitian yang digunakan dalam penulisan ini adalah penelitian yuridis empiris yaitu mengkaji persoalan hukum yang dilakukan dengan cara langsung mengunjungi lokasi penelitian. Dalam hal ini konteks penelitian empiris adalah penelitian terhadap pelaksanaan perundang-undangan. Teknik yang digunakan berupa data primer yang menggunakan observasi untuk menelaah lebih dalam mengenai permasalahan yang didukung dengan studi literatur wawancara serta dokumentasi yang dilakukan kepada pihak-pihak Suku Dinas Perhubungan dan Transportasi Jakarta Utara, serta menggunakan kuesioner yang ditujukan kepada masyarakat Kelurahan Tugu Utara. Hasil yang diperoleh adalah kebanyakan masyarakat DKI Jakarta khususnya Tugu Utara tidak memiliki parkir pribadi atau garasi. Masyarakat masih sedikit peran sertanya dalam penegakan pasal 140 ayat (1) dan (2) Undang – Undang nomor 5 Tahun 2014 tentang transportasi dan kewajiban dalam memiliki parkir pribadi di Jakarta Utara yang berjalan kurang efektif dan kurang ditaati oleh para pemilik kendaraan bermobil di Jakarta Utara.
English Abstract
Currently, a massive invasion by private vehicles require a large proportion of space which causing in narrower road capacity and lead to congestion. In fact, the government has not been able to actualize the public transportation modes which are comfortable and safe for the community to date. There are still many people who do not provide the appropriate garage for their vehicle owned and parked their vehicles on the road. The type of research used in this paper is empirical juridical research with aims to examine the legal issues conducted by direct visit the research location. In this context, the empirical research is the study of how the implementation of legislation. Technique used in the form of primary data is observation to deeper analyze about the problems supported by the study of literature, interview and documentation done to the Sub Department of Transportation of North Jakarta, and also using questionnaires addressed to community of North Tugu Village. The result obtained is that most people of DKI Jakarta, especially North Tugu Village do not have their private parking or garage. Thus, the community still less participates in the enforcement of Article 140 paragraph (1) and (2) Law number 5 of 2014 on transportation proved by the failure to comply with the obligation to own private parking in North Jakarta which runs less effective and less adhered by car owners in North Jakarta .
