Abstract
Pada skripsi ini, penulis mengangkat permasalahan mengenani buruh migran tak berdokumen. Hal ini dilatar belakangi oleh bahwa jumlah buruh migran Indonesia yang tak berdokumen jauh lebih banyak dibandingkan yang berdokumen. Buruh migran tak berdokumen pada sisi lain adalah orang-orang yang rentan akan pelanggaran HAM oleh orang – orang yang memiliki kekuasaan. Mereka dieksploitasi oleh orang-orang yang memanfaatkan status illegal mereka. Harus dipahami bahwa yang illegal bukan pekerjaan yang mereka lakukan tetapi keberadaan mereka yang tanpa dokumen itulah yang illegal. Berdasarkan hal tersebut diatas, karya tulis ini mengangkat rumusan masalah: bаgаimаnа sehаrusnyа perlindungаn terhаdаp buruh migrаn tidаk berdokumen (undocumented migrаnt workers) terkаit dengаn hаk effective remedy berdаsаrkаn regulаsi internаsionаl Kemudian penulisan karya tulis ini menggunakan penelitian Yuridis Normatif. Penelitian ini dilakukan dengan pendekatan Statuta Approach yaitu pendekatan perundang-undangan dan Comparative Approach yaitu pendekatan komparatif. Berdasarkan Statuta Approach penulis akan menganalisa dan mengkritisi instrument Perburuhan dan HAM baik ditingkat ASEAN maupun internasional. Sedangkan Comparative Approach untuk memberikan perbedaan signifikan untuk HAM di ASEAN dan di regional lainnya. Dari hasil penelitian dengan menggunakan metode diatas, penulis memperoleh jawaban atas permasalahan yang ada bahwa buruh migran tidak berdokumen beserta keluarganya berhak atas perlindungan. Perlindungan yang dimaksud adalah terpenuhinya hak asasi manusia yang berlaku bagi seluruh buruh migran. Hak asasi manusia bagi tenaga kerja yang dilindungi Undang-Undang 1945 berupa perlakuan yang adil dan layak dalam hubungan kerja serta kehidupan yang layak bagi kemanusiaan. Bagaimana pun juga hak-hak fundamental para pekerja migran yang tidak berdokumentasi ini tetap diberikan, setidak-tidaknya karena mereka adalah sama sebagai manusia dan warga negara.
English Abstract
In this thesis, the authors raised the problems of undocumented undocumented migrant workers. This is due to the fact that the number of undocumented Indonesian migrant workers is much higher than that documented. Undocumented migrant workers on the other hand are the ones who are vulnerable to human rights violations by those in power. They are exploited by people who take advantage of their illegal status. It must be understood that the illegal are not the work they do but the existence of those without documents is illegal. Based on the above, this paper raises the formulation of the problem: In fact, the protection of undocumented migrant workers is limited by effective remedy in the case of internal regulators? Then the writing of this paper using Juridical Normative research. This research is done by Approach Statute approach that is approach of legislation and Comparative Approach that is comparative approach. Based on Statute of Approach the author will analyze and criticize Labor and Human Rights instruments both at ASEAN and International level. While the Comparative Approach to provide significant differences for human rights in ASEAN and in other regions. From the results of research using the above methods, the authors obtain answers to the existing problems that undocumented migrant workers and their families are entitled to protection. The protection in question is the fulfillment of human rights applicable to all migrant workers. Human rights for workers protected by the 1945 Act are fair and equitable treatment of employment and decent living for humanity. However, the fundamental rights of these undocumented migrant workers are still given, at least because they are the same as human beings and citizens.
