Abstract
Penelitian ini membahas pertentangan norma mengenai konsep perkawinan sedarah antara hokum adat Tionghoa dan UU Perkawinan. Dimana menurut hokum adat Tionghoa seseorang diperbolehkan menikah dengan seseorang yang termasuk dalam larangan perkawinan menurut Pasal 8 UU Perkawinanasalkanmerekatidakmemilikimarga(she) yang sama. Berdasarkan hal tersebut, masalah yang dirumuskan terkait keabsahan perkawinan seadaraholehwarganegara Indonesia keturunanTionghoadikaitkandenganlaranganperkawinan dalamPasal 8 Undang- UndangNomor 1 Tahun 1974 TentangPerkawinan. Penelitianinimenggunakanmetodeyuridisnormatif, denganmenggunakanpendekatanpendekatankonseptual, kemudiandihubungkandenganpermasalahan yang ada, sertadianalisismenggunakanpenafsirangramatikaldanpenafsiransistematisuntukme nganalisiskeabsahanperkawinanseadaraholehwarganegara Indonesia keturunanTionghoadikaitkandenganlaranganperkawinan di Pasal 8 Undang- UndangNomor 1 Tahun 1974 TentangPerkawinan. HasilpenelitianmenunjukkanbahwaperkawinanmenuruthukumadatTiongho a yang dilakukanolehWarga Negara Indonesia keturunanTionghoaadalahsahsehinggatidakdapatdibatalkan, karenaperkawinantersebuttelahsesuaidenganaturanhukumadatperkawinanTiongho a, dan juga memperhatikanketentuanhukumperkawinan di Indonesia terutamalaranganperkawinanmenurutPasal 8 UU PerkawinanPerkawinan .Hal tersebutdikarenakanketentuanPasal 8 UUP yang bersifatanfullendrecht (mengatur), sebagaimanadalamPasal 8 huruf f UUP merupakanketentuanpengecualiandariketentuanPasal 8 huruf a sampaidengan e UUP.
English Abstract
This study discusses the contradictory norms regarding the concept of inbreeding marriage between Chinese customary law and Marriage Law. Where according to Chinese customary law a person is permitted to marry someone who is included in the marriage prohibition under Article 8 of the Marriage Law provided that they do not have the same surname. Based on this, the problem formulated related to the legitimacy of marriage as harmful by Indonesian citizens of Chinese descent is associated with the prohibition of marriage in Article 8 of Law Number 1 Year 1974 onMarriage This study uses normative juridical methods, using a conceptual approach approach, then linked to existing problems, and analyzed using grammatical interpretation and systematic interpretation to analyze the legitimate validity of marriage by Indonesian citizens of Chinese descent associated with the marriage ban in Article 8 of Law Number 1 Year 1974 About Marriage. The results of the study indicate that the marriage according to Chinese customary law conducted by Indonesian citizens of Chinese descent is legitimate so that it can not be canceled because the marriage has been in accordance with the customary law of Chinese marriage, and also pay attention to the provisions of marriage law in Indonesia especially marriage prohibition according to Article 8 Marriage Marriage Law. This is due to the provision of Article 8 of the UUP which is anfullendrecht (regulating), as in Article 8 letter f of the UUP is an exception provision of the provisions of Article 8 letter a to e UUP
