English Abstract
In this thesis, the researcher raised the topic regarding criminalization of marriange contract based on protection of women. The choice of theme was based on the emptiness of law (vacuum of norm) related to the rule of law marriage contract. Based on those facts, this thesis consists a few questions as follows: (1) How’s the criminalization of marriage contract based on protection of women? (2) How’s the formulation of norm of law contra-marriange contract based on protection of women in the future?. The method that’s being used in this research was normative legal research using statue approach and conceptual approach. The legal material that was being used consists of primary law source and secondary law source then analyzed using interpretation grammatical and interpretation sistematic.Based on the result of the analysis process using the methods above, the researcher concludes that the emptiness of law that happens regarding marriage contract based on protection of women,based on philosophical basis, juridicial basis, and sociological basis that results in criminalization as the criminal law policy. The other thing is that the real example of criminalization comes in the form of criminal law formulation policy which concept was formed by protection of women.
