Abstract
Secara Konsepsional, inti dan makna dari Perlindungan Hukum terhadap Konsumen berorientasi terhadap pentingnya kepastian hukum dalam setiap segi bidang layananan transportasi berbasis online. Kesesuaian suatu kontrak dapat dilihat dari Pasal 1320 KUHPerdata mengenai sahnya perjanjian. Perjanjian bukan hanya suatu yang mengikat apa dengan tegas ditentukan di dalamnya tapi juga segaala sesuatu yang karena sifatnya perjanjian dituntut berdasarkan keadilan. Syarat-syarat yang ada pada setiap perjanjian menurut Pasal 1320 KUHPerdata, harus ada dalam ketentuan penggunaan pada aplikasi GO-JEK. Oleh karena itu sangatlah dapat dikaji lebih lanjut tentang ketegasan syarat sah perjanjian dalam ketentuan penggunaan aplikasi GO-JEK. kesepakatan kontrak elektronik sebagai dasar dari perjanjian antara duabelah pihak yang mengadakan perjanjian. Hasil Penelitian menunjukkan bahwa untuk memberikan perlindungan hukum bagi konsumen layanan tranportasi dengan aplikasi online ialah dengan memperkuat regulasi mengenai perjanjian yang menggunakan basis online serta bentuk bentuk perlindungan hukum bagi masyarakat yang menggunakan layanan tersebut apabila terjadi masalah yang dapat merugikan masyarakat. Dalam Pasal 1313 KUHPerdata menyatakan bahwa suatu perjanjian adalah suatu perbuatan satu orang atau lebih mengikatkan dirinya terhadap satu orang atau lebih. Teori perlindungan hukum merupakan salah satu teori yang digunakan sebagai pijakan terhadap masalah, karena faktor kajian teori ini pada perlindungan hukum yang di berikan kepada masyarakat. Masyarakat yang di maksud ini ialah masyarakat yang berada pada posisi lemah, baik secara ekonomis maupun lemah dari aspek yuridis.
English Abstract
Conceptionsally, the core and meaning of the Legal Protection of Consumers are oriented towards the importance of legal certainty in every aspect of the field of online-based transport services. The conformity of a contract can be seen from Article 1320 of the Civil Code regarding the validity of the agreement. The covenant is not just a binding what is firmly defined in it but also everything that is due to the nature of the covenant demanded by justice. The terms of any agreement under Article 1320 of the Civil Code, shall be in the terms of use in the GO-JEK application. Therefore, it can be studied further about the firmness of the legal terms of agreement in the terms of use of GO-JEK applications. An electronic contract agreement as the basis of the agreement between the parties that entered into the agreement. The results of the study show that to provide legal protection for consumers of transport services with online applications is to strengthen the regulation of agreements using online bases and forms of legal protection for the people who use the service in case of problems that can harm the community. Article 1313 of the Civil Code states that a covenant is an act of one or more persons committed to one or more persons. The theory of legal protection is one of the theories used as a foothold against the problem, because the factor of study of this theory on the legal protection that is given to the community. Communities in this sense is a society that is in a weak position, both economically and weakly from the juridical aspect.
