Abstract
Berdasarkan latar belakang diatas, karya tulis ini mengangkat rumusan masalah: Bagaimana kewenangan memutus dan menyelesaikan perselisihan tentang upah lembur berdasarkan Undang-undang Nomor 2 Tahun 2004 tentang perselisihan Hubungan Industrial dengan Keputusan menteri Nomor 102 Tahun 2004 Tentang Waktu kerja lembur dan upah kerja lembur?. Penelitian ini menggunakan jenis penelitian yuridis normatif dengan menggunakan pendekatan Statue Aprroach dan Case Approach. Analisis data pada penelitian ini dilakukan melalui interpretasi, yakni interpretasi gramatikal dan interpretasi ekstensif. Dari hasil penelitian, penulis memperoleh jawaban atas rumusan masalah yaitu mengenai kewenangan pegawai pengawas ketenagakerjaan dalam menentukan upah lembur dalam hal terjadi perselisihan, dimana Pengadilan Hubungan Industrial merupakan pengadilan khusus yang dibentuk dilingkungan pengadilan negeri yang berwenang mengadili, memeriksa dan memberikan putusan terhadap permasalahan perselisihan hubungan industrial, Dalam melakukan penyelesaian perselisihan hubungan indutrial tidak dikenal lembaga banding, karena dalam perselisihan ini hanya dikenal di lembaga kasasi.
English Abstract
Based on the above background, this paper raises the formulation of the problem: How is the authority to decide and settle disputes over overtime wages based on Law No. 2 of 2004 on industrial relations disputes with Ministerial Decree Number 102 Year 2004 About Overtime and overtime working hours? This research uses normative juridical research by using approach of Statue Aprroach and Case Approach. Data analysis in this research is done through interpretation, namely grammatical interpretation and extensive interpretation. From the result of the research, the writer got answer to the problem formulation that is concerning the authority of the labor inspector in determining overtime wages in case of dispute, where the Industrial Relations Court is a special court established in the court of state authorized to examine and give decision on industrial relations disputes , In the settlement of disputes relating indutrial unknown appeals agencies, because in this dispute only known in the cassation institution.
