Abstract
Pada penelitian ini bertujuan untuk mengetahui dan menganalisis mengenai indikator untuk mengetahui kesamaan (similarity) antara kedua program televisi sehingga dapat dikatakan sebagai pelanggaran hak cipta ditinjau dari Pasal 1 angka 1 dan 3 UU Hak Cipta serta untuk mengetahui dan menganalisis mengenai perlindungan hukum bagi pemegang hak cipta tayangan Celebrity Lipsync Battle. Metode penelitian pada skripsi ini menggunakan jenis penelitian yuridis normatif dan menggunakan pendekatan perundang-undangan (statute approach) dan pendekatan kasus (case approach). Hasil penelitian ini ialah bahwa beberapa indikator untuk membuktikan bahwa program televisi Celebrity Lipsync Combat dapat dikatakan sebagai pelanggaran hak cipta, dengan mengaitkannya pada Pasal 1 angka 1 dan 3, Pasal 44 UU Hak Cipta serta beberapa teori diantaranya Sweat of the Brow Doctrine, Creativity Doctrine, Substantial Similarity Test, serta Idea and Expression Dichotomy. Di samping itu, digunakan pula access theory dan similarity theory untuk membuktikan adanya akses yang digunakan oleh NET TV dalam mengambil kesamaan substansial dari program televisi tersebut, sehingga kesamaan (similarity) juga dapat dibuktikan dengan similarity theory, dimana keduanya saling berkaitan satu sama lain. Bentuk perlindungan hukum bagi pemegang hak cipta program televisi merujuk pada perlindungan preventif dan represif.
English Abstract
This study aimed at investigating and analyzing the indicators in finding similarity between two television programs to be entitled with copyright violation seen from article 1 number 1 and 3 of Law of Copyright and investigating and analyzing the legal protection made available for the copyright of Celebrity Lipsync Battle. This study employed normative juridical method with statute and case approaches. The results of the study show that the indicators used to prove that Celebrity Lipsync Battle as a violation of copyright are by referring to article 1 number 1 and 3 of article 44 on Law of Copyright and several theories such as Sweat of The Brow Doctrine, Creativity Doctrine, Substantial Similarity Test, and Idea and Expression Dichotomy. Besides, access theory and similarity theory were used to prove that NET TV had an access to take substantial similarity so that the similarity could also be proven using similar theory in which both were interrelated. The legal protection provided for the copyright holder was designed by refering to the preventive and repressive protection
