Abstract
Penelitian ini membahas tentang Efektivitas pasal 8 ayat 1 peraturan Bupati Blitar nomor 3 tahun 2013 tentang izin usaha warung internet. Berdasarkan fakta dapat diketahui bahwa tempat usaha Warung Internet yang ada di Kecamatan Selopuro Kabupaten Blitar sudah banyak yang berdiri tetapi hanya sedikit saja yang telah mendaftarkan usaha mereka ke dinas perhubungan, komunikasi dan informatika Kabupaten Blitar. Berdasarkan latar belakang tersebut, maka rumusan masalah pada penelitian ini adalah (1)Bagaimana Efektivitas pasal 8 ayat 1 Peraturan Bupati Blitar Nomor 3 Tahun 2013 tentang Izin Usaha warung Internet (warnet) di Kecamatan Selopuro Kabupaten Blitar ? (2) Apa Hambatan dan Solusi pelaksanaan pasal 8 ayat (1) Peraturan Bupati Blitar Nomor 3 Tahun 2013 tentang Izin Usaha warung Internet (warnet) di Kecamatan Selopuro Kabupaten Blitar ? Penelitian ini menggunakan jenis penelitian yuridis empiris dengan metode pendekatan yuridis sosiologis. Lokasi penelitian di Dinas Perhubungan, komunikasi dan informatika Kabupaten Blitar dan sejumlah warung internet yang ada di kecamatan Selopuro Kabupaten Blitar. Jenis dan Sumber data adalah data primer dan data sekunder. Data primer dapat diperoleh dengan melakukan wawancara langsung dengan narasumber. Data sekunder diperoleh dari studi kepustakaan, pendapat dari ahli hukum dan studi internet. Teknik analisa data adalah deskriptif analisis. Dari hasil penelitian ini dapat diketahui, bahwa Efektivitas pasal 8 ayat 1 Peraturan Bupati Blitar Nomor 3 Tahun 2013 tentang Izin Usaha warung Internet (warnet) di Kecamatan Selopuro Kabupaten Blitar belum berjalan efektif. Terdapat beberapa faktor yang menyebabkan penanganan Perizinan Warung Internet belum berjalan efektif, yaitu faktor penegak hukum, faktor sarana atau fasilitas yang mendukung penegakan hukum, faktor masyarakat, faktor kebudayaan.
English Abstract
This study discusses the effectiveness of article 8, paragraph 1 Blitar regent regulation No. 3 of 2013 concerning the business license internet cafes. Based on the fact it can be seen that the first Internet Café in Sub Selopuro Blitar many are standing but only a few who have registered their businesses to the transportation department, communication and informatics Blitar. Based on this background, the formulation of the problem in this study are (1) How Effectiveness of article 8, paragraph 1 Blitar Regent Regulation No. 3 of 2013 on Business Permit Internet cafes (cafe) in District Selopuro Blitar? (2) What Obstacles and Solutions implementation of article 8, paragraph (1) of Regulation No. 3 of Blitar Regent 2013 on Business Permit Internet cafes (cafe) in District Selopuro Blitar? This research uses empirical juridical with sociological juridical approach. The location of research in the Department of Transportation, communication and informatics Blitar and a number of internet cafes in sub Selopuro Blitar. Types and Sources of data are the primary data and secondary data. The primary data can be obtained by direct interviews with sources. Secondary data were obtained from literature studies, opinions of legal experts and internet study. Data analysis technique is descriptive analysis. From these results it can be seen, that the effectiveness of article 8, paragraph 1 Blitar Regent Regulation No. 3 of 2013 on Business Permit Internet cafes (cafe) in the district of Blitar Selopuro had not been effective. There are several factors that cause handling Licensing Public Internet has not been effective, the law enforcement apparatus, factors means or facilities to support law enforcement, community factors, cultural factors.
