Abstract
Konsumen mempunyai hak untuk dilindungi dari praktik bisnis seminar yang tidak beretika. Tentunya akibat dari praktik bisnis seminar yang mengandung unsur informasi yang menyesatkan, konsumen dalam hal ini menjadi korban dan akibat lemahnya posisi dari konsumen tersebut dia tidak dapat berbuat apa-apa. Pemerintah membentuk suatu produk hukum yakni peraturan perundang-undangan dengan bentuk produk hukum yakni Peraturan Perundang-Undangan Negara Kesatuan Republik Indonesia Nomor 8 tahun 1999 yang berkaitan dengan hal perlindungan konsumen. Tetapi ternyata peraturan perundang-undangan tersebut hanya melindungi korban yang sudah terkena dampak dari kerugian yang dideritanya akibat pelaku usaha tanpa adanya upaya pencegahan didalam melindungi kepentingan dan hak konsumen dari korban tindak pidana dan ternyata tidak ada pengaturan lebih lanjut terkait dengan pengaturan praktik bisnis seminar yang mengandung informasi yang menyesatkan Oleh karenanya, Peneliti kemudian mengajukan beberapa rumusan masalah, yaitu : (1) Bagaimana pengaturan hukum perlindungan konsumen di Indonesia terhadap praktik bisnis seminar? (2) Bagaimana seharusnya pengaturan hukum perlindungan konsumen terhadap praktik bisnis seminar dimasa yang akan datang? Kemudian penulisan Tesis ini menggunakan metode yuridis normative dengan metode pendekatan perundang-undangan (Statute Approach). Bahan hukum primer, sekunder, dan tersier yang diperoleh peneliti akan dianalisis menggunakan teknik analisis yakni deskriptif analisis yaitu metode analisis bahan hukum dengan cara melakukan menentukan isi atau makna dari aturan hukum, dari aturan internasional, pendapat para ahli hukum pidana, yang dijadikan sebagai rujukan dalam menyelesaikan permasalahan hukum yang menjadi objek kajian.
English Abstract
Consumers have the right to be protected from unethical ethical business practices. Certainly the result of a seminar business practice containing misleading information elements, the consumer in this case becomes a victim and due to the weak position of the consumer he can not do anything. The Government establishes a legal product that is legislation with the form of legal products namely Regulation of the Republic of Indonesia Unitary Law Number 8 of 1999 relating to consumer protection. However, the law only protects the victims who have been affected by the loss suffered by the business actors without any prevention efforts in protecting the interests and rights of consumers of the victims of the crime and there is no further regulation related to the regulation of seminar business practices that contain misleading information Therefore, the Researcher then proposed some formulation of the problem, namely: (1) How to regulate consumer protection law in Indonesia against the practice of seminar business? (2) How should the consumer protection law regulation be applied to future seminar business practices? Then the writing of this thesis uses normative juridical method with statutory approach approach (Statute Approach). The primary, secondary, and tertiary law material obtained by the researcher will be analyzed using analytical technique that is descriptive analysis that is the method of analysis of legal material by way of determining the content or meaning of the rule of law, from the international rule, the opinion of the criminal law expert, which serve as the reference in solve the legal issues that become the object of study.
