Abstract
Indonesia merupakan negara yang memiliki banyak Pengetahuan Tradisional dan Ekspresi Budaya Tradisional yang lahir dari keanekaragaman budaya masyarakatnya. Salah satunya adalah tradisi upacara Labuhan Keraton Yogyakarta. Tradisi upacara ini sudah berlangsung sejak nenek moyang dan hingga saat ini terus dilestarikan oleh generasinya secara turun
English Abstract
Indonesia is a country that is rich with traditional knowledge and folklore emerging from the diversity of the people. One of them is traditional ceremony called Labuhan Keraton Yogyakarta. The ceremony has been practiced since ancient times and has been preserved until present over the generations. The ceremonial traition needs to be protected and preserved as the original variety of Indonesia. The protection is necessary since there is chance for other countries to take over Indonesian traditional knowledge and folklore to be claimed and exploited without the consent from Indonesia and that the act gives no shared profit. Based on the background stated above, the research objectives were: (1) To know and explain whether traditional ceremony of Labuhan Keraton Yogyakarta was the object to the protection of traditional knowledge and folklore according to article 38 paragraph 2 of Law number 28 year 24; (2) to know the obstacle faced and solutions offered by the government of Yogyakara province in protecting traditional ceremony of Labuhan Keraton Yogyakarta. This research was conducted using empirical juridical method with sociological approach. Primary and secondary data obtained in the research was analyzed using descriptive pualitative tehnique. The findings of the study show that traditional ceremony of Labuhan Keraton Yogyakarta is categorized as the object of protection of traditional knowledge and folklore because it has met the criteria contained in the document of WIPO Intergovermental Commitee on Intelectual Property on Generic Resources Traditional Knowledge and the Folklore (IGC) 33 sesson, Jeneva, 27
