Abstract

Sebagaimana strategi pemerintah dalam pembentukan holding BUMN dengan melalui penyertaan modal negara, maka berlakulah Peraturan Pemerintah Nomor 72 Tahun 2016 tentang tata cara penyertaan dan penatausahaan Modal negara. Peraturan pemerintah ini menimbulkan berbagai macam reaksi dari masyarakat karena bertentangan dengan peraturan perundang-undang lain, salah satunya adalah Undang-Undang Nomor 17 Tahun 2003 tentang Keuangan Negara. Dalam undang-undang tersebut mengatur bahwa pemberian penyertaan modal negara terlebih dahulu ditetapkan dalam APBN. Hal ini berbeda dengan apa yang diatur dalam Peraturan Pemerintah nomor 72 tahun 2016 yang menyatakan penyertaan modal negara yang berasal dari saham milik negara dilakukan pemerintah tanpa melalui mekanisme APBN. Konflik norma ini menjadi isu hukum yang penting untuk segera dilakukan suatu upaya penyesuaian (sinkronisasi) norma.

English Abstract

Similar with the government strategy in the establishment of State’s Enterpriss holding through the inclusion of state’s capital, the government also implements Government Regulation number 72 year 2016 about the procedures and administration of state’s capital. This government regulation sparks various reactions from society because it contradicts other legislations and one of them is Law number 17 year 2003 about state’s finances. That law governs that capital inclusion must be first stipulated in State’s Budget. This is different from what is regulated in Government regulation number 72 year 2016 stating that capital inclusion coming from state-owned shares can be done by government without going through the mechanism of state’s budget. This conflict of norms is a legal issue that needs to be synchronized.
