Abstract

Penelitian ini untuk mengetahui pelaksanaan perlindungan hukum hak cipta atas ajaran perguruan kebatinan jawa oleh Pemerintah Kota Madiun dan Kabupaten Madiun berdasarkan Pasal 38 Ayat 2 Undang-Undang No. 28 Tahun 2014 tentang Hak Cipta dan berbagai hal yang menghambat dalam pelaksanaan perlindungan hukum tersebut serta upaya untuk mengatasi hambatan dalam pelaksanaan perlindungan hukum hak cipta atas ajaran Perguruan Kebatinan Jawa Di Kota Dan Kabupaten Madiun. Penelitian ini bersifat yuridis empiris dengan pendekatan yuridis sosiologis yang memfokuskan pada permasalahan perlindungan hukum terhadap hak cipta ajaran perguruan kebatinan jawa, lalu melakukan analisis dan kesimpulan secara induktif. Pendokumentasian buku berjudul “ajaran wewarah sapta sila” dan buku yang berjudul “Sangkan Paran” Sapta Sila merupakan salah satu upaya inventarisasi pemerintah, untuk upaya menjaga telah dibentuknya Lembaga Majelis Luhur Kepercayaan Indonesia yang berkaitan dengan pembinaan dan musyawarah seluruh organisasi kebatinan serta pembentukan panitia pengawas kepercayaan PAKEM di Kota Dan Kabupaten Madiun untuk segala kegiatan rutin perguruan. Diadakanya sarasehan pembinaan penghayat kepercayaan terhadap Tuhan Yang Maha Esa untuk meningkatkan peran penghayat kepercayaan dalam rangka pelestarian nilai budi pekerti luhur, pembangunan karakter dan penguatan jati diri bangsa dan menjalin kerukunan dan hubungan harmonis dalam kehidupan beragama antar penghayat kepercayaan merupakan salah satu upaya memelihara. Sifat perguruan yang cenderung tertutup mengenai ajaran perguruan dan Belum dibuatkanya PP tentang mengatur EBT adalah salah satu yang menjadi hambatan pemerintah dalam pelaksanaan perlindungan hukum. Serta upaya untuk mengatasi hambatan tersebut yaitu dengan meningkatkan pembinaan, memberikan masukan dan musyawarah pada perguruan mengenai pentingnya perlindungan hukum yaitu berkaitan dengan inventarisasi, menjaga dan memelihara ajaran perguruan kebatinan jawa.

English Abstract

This study aimed at nvestigating the legal protection for the copyright of the teaching of Javannese’ Kebatinan by the government of Madiun City and Madiun Regency based on article 38 paragraph 2 of Law Number 28 year 2014 about Copyright and the inhibiting factors as well the solutions offered to the problems. This study was empirical juridical by design with sociological juridical approach focusing on the issues of legal protection for the copyright of the teaching of Javannese’Kebatinan. The analysis and conclusion was done inductively. The documentation of books entitled ‘ Ajaran Wewarah Sapta Sila’ and ‘ Sangkan Paran’ was one of the ways of inventory done by the government. Organizaton of Majelis Luhur Kepercayaan Indonesia has been established in relation to coaching and discussion of all Kebatinan organizations. A committee of supervisor of Kebatinan PAKEM in Madiun city and Madiun Regency for all routine activities of the organization.Workshop for the believers of omnipotent God to iprove their role in the preservation of good conduct, character building and strengthening of national identity as well as good relation among the believers are some of the ways done for maintenance. The organizations which are usually extrovert about their teachings and the absence of rules regulating EBT are some of the inhibiting factors for the government to provide legal protection. The solutions offered to overcome the problems are improving the coaching, providing inputs and facilitating discussion on the importance of legal protection that is related with inventory, and maintaining and preserving the teachings of Javanesse’ Kebatinan.
