Abstract

Penelitian ini bertujuan untuk mendiskripsikan dan menganalisis Efektivitas Pasal 19 Ayat 3 Peraturan Daerah Kota Malang Nomor 1 Tahun 2012 Tentang Bangunan Gedung Terkait Renovasi Bangunan Gedung Yang Mengalihkan Fungsi Bangunan Gedung. Penelitian ini merupakan penelitian yuridis empiris dengan metode pendekatan yuridis sosiologis. Data primer dan data sekunder yang diperoleh penulis dianalisis dengan menggunakan metode interpretasi data. Hasil penelitian menunjukkan bahwa terdapat beberapa strategi terhadap Efektivitas pasal 19 ayat 3 Peraturan Daerah Kota Malang Nomor 1 Tahun 2012 Tentang Bangunan Gedung Terkait Renovasi Bangunan Gedung Yang Mengalihkan Fungsi Bangunan Gedung, yaitu dengan meningkatkan pengetatan pengawasan yang mulai dilihat dari awal pembuatan AP (Advice Planning), meningkatkan kesadaran masyarakat untuk mematuhi peraturan pemerintah. Kendala yang dihadapi Dinas Pekerjaan Umum, Perumahan dan Pengawasan Bangunan dalam Efektivitas Pasal 19 Ayat 3 Peraturan Daerah Kota Malang Nomor 1 Tahun 2012 Tentang Bangunan Gedung Terkait Renovasi Bangunan Gedung Yang Mengalihkan Fungsi Bangunan Gedung adalah sebagian pemilik bangunan tidak memperbarui IMB yang sesuai dengan keadaan di lapangan, karena merasa tanah milik sendiri. Upaya yang dilakukan oleh Dinas Pekerjaan Umum, Perumahan dan Pengawasan Bangunan adalah bertindak lebih tegas terhadap pelanggar dengan cara mengeluarkan Surat Keputusan pencabutan kepada pendiri bangunan dan membuat surat kepada Satpol PP terkait dengan pelanggaran perubahan fungsi rumah tinggal menjadi rumah kost untuk dilakukan penindakan Satuan Polisi Pamong Praja sesuai dengan undang-undang yang berlaku.

English Abstract

This research is aimed to describe and analyze The Effectiveness of Article 19, Paragraph 3 Malang City Local Regulation Number 1 year 2012 on Building Related to Renovations of Buildings in Transfering Buildings Function. This research is empirical juridical research by approching sociological juridical method. Primary and secondary data obtained by the author is analyzed by interpretation data method. The result of this research showed that there were some of strategies toward The Effectiveness of Article 19, Paragraph 3 Malang City Local Regulation Number 1 year 2012 on Building Related to Renovations of Buildings in Transfering Buildings Function. These strategies are increase the tightening supervision starting from supervice the begining of AP (Advice Building) construction, and increase the public awareness to obey the government rules. Problem faced by public works, housing, and building control in terms of effectiveness of that article was some of the bulding owner did not renewal the IMB that was suitable with the condition in that location because it found that they feel have a right to control their own land. The effort conducted by public works, housing, and building control was act firmer toward the violator by issuing the revocation decision letter to the builder and also a letter to the municipal police related to the violation of changes of the private house to become a boarding house to conduct the police prosecution unit of the civil service in accordance with the legislation yet still in force.
