Abstract

Setiap tahun Indonesia mengalami peningkatan dalam dunia usaha. Hal ini merupakan dampak dari pesatnya perkembangan globalisasi dan liberalisasi perdagangan di seluruh dunia. Besar kecilnya suatu usaha berpengaruh pada lamanya waktu pekerja/buruh di lingkungan kerja untuk bisa memproduksi barang atau jasa. Dampak yang bisa dirasakan oleh pekerja/buruh adalah kecelakaan kerja dan penyakit akibat kerja. Untuk mengurangi dampak tersebut suatu korporasi perlu melaksanakan syarat keselamatan dan kesehatan kerja (K3) dalam lingkungan kerja. Namun kesadaran dan penerapan keselamatan dan kesehatan kerja (K3) di Indonesia masih tergolong minim. Hal ini diketahui dari masih tingginya angka kecelakaan kerja. Angka kecelakaan kerja pada tahun 2015 berjumlah 50.089 menunjukkan penerapan keselamatan dan kesehatan kerja (K3) belum diterapkan secara signifikan. Apabila angka kecelakaan kerja masih tinggi bisa jadi korporasi selaku pemilik dan penanggung jawab tidak memiliki kesadaran untuk menerapkan keselamatan dan kesehatan kerja (K3) serta menganggap sepele keselamatan pekerjanya. Hal ini bisa ditelusuri lebih lanjut apakah korporasi lalai atau menganggap sepele jika dilakukan penyelidikan, namun korban jarang untuk melaporkan ke kepolisian dan menyelesaikan kasus kecelakaan kerja secara kekeluargaan atau diluar pengadilan melalui mediasi penal karena dianggap cepat dan tidak memakan biaya. Berdasarkan hal tersebut penulis ingin meneliti mengenai mediasi penal dalam hal terjadi kecelakaan kerja.

English Abstract

In Indonesia, the trade market increasing every year. This becomes an affect of globalization that developing fast and also the market liberalization in the entire world. The size of a trade affect the working duration of the worker to produce the goods or service. The effects that can be felt by the workers are working accident and sick of working. To alleviate those effects, hygiene standarts in working circles. But unfortunately, the awareness and application of working safety hygiene in Indonesia are still under the line. This shown in the percentage of working accident that still high. In 2015, the number of working accident reaches 50.089, which shows that the application of working safety and hygiene still not significant yet. If the numbers of the working accident still high, it can be the corporation as the owner and ris-taker do not have awareness to apply working safety and hygiene, also still consider their worker’s safety as something that is not important enough. This things can be seen further, whether corporation careless or consider survey as something that trivial, but the victim rarely report to the police and solve a case of working accident in peaceful way or outside the court through penal mediation because it faster and doesn’t need much money. Based on those things, author wants to do a research about penal mediation in case of working accident.
