Abstract

Pada skripsi ini, penulis mengangkat permasalahan mengenai penegakan sanksi administratif Bagi Pelanggar Pasal 15 Ayat (2) Huruf C Peraturan Daerah Kabupaten Gresik Nomor 3 Tahun 2021 Tentang Pengurangan Penggunaan Plastik Sekali Pakai. Hal ini dilatar belakangi volume sampah plastik yang kian meningkat, dan juga menimbulkan dampak negatif bagi lingkungan dan kesehatan manusia sehingga pemerintah Kabupaten Gresik mengundangkan Peraturan Daerah tersebut agar masyarakat dapat mengurangi timbulan sampah tak terkecuali plastik dengan memilah sampah terlebih dahulu dan tidak dibuang secara sembarangan. Berdasarkan latar belakang diatas, penulis mengangkat rumusan masalah: 1). Bagaimana penegakan sanksi administratif bagi pelanggar Pasal 15 Ayat (2) Huruf C Peraturan Daerah Kabupaten Gresik Nomor 3 Tahun 2021 tentang Pengurangan Penggunaan Plastik Sekali Pakai di Kabupaten Gresik? 2). Apa saja hambatan dan upaya dalam penegakan sanksi administratif bagi pelanggar Pasal 15 Ayat (2) Huruf C Peraturan Daerah Kabupaten Gresik Nomor 3 Tahun 2021 tentang Pengurangan Penggunaan Plastik Sekali Pakai di Kabupaten Gresik? Kemudian penulisan menggunakan jenis penelitian sosio legal dengan metode pendekatan yuridis sosiologis yang bahan data diperoleh dari wawancara, dokumentasi dan kuisioner. Dari hasil penelitian diperoleh bahwa penegakan sanksi administratif bagi pelanggar Pasal 15 Ayat (2) Huruf C Peraturan Daerah Kabupaten Gresik Nomor 3 Tahun 2021 tentang Pengurangan Penggunaan Plastik Sekali Pakai di Kabupaten Gresik tidak berjalan efektif karena dari semua faktor yang mempengaruhi penegakan hukum yaitu faktor hukum, faktor penegak hukum, faktor sarana dan prasarana, faktor masyarakat serta faktor kebudayaan di masyarakat tidak satupun yang terpenuhi. Adapun faktor yang menghambat dari penegakan sanksi administratif ialah dari faktor perundang-undangan berupa Peraturan Bupati sebagai aturan pelaksana dari Peraturan Daerah Kabupaten Gresik Nomor 3 Tahun 2021 belum juga diundangkan dan kurangnya anggaran yang memadai. Sedangkan upaya yang sudah dilakukan sejauh ini untuk membuat Peraturan Daerah Tersebut berjalan efektif ialah melakukan sosialisasi tentang peraturan terkait dan peningkatan sarana dan prasarana beupa TPS 3R dan TPST.

English Abstract

In this thesis, the author raises issues regarding the enforcement of administrative sanctions for violators of Article 15 paragraph (2) letter c of Gresik Regency Regional Regulation Number 3 of 2021 concerning Reducing the Use of Single-Use Plastics. This is against the background of the increasing volume of plastic waste, and also has a negative impact on the environment and human health so that the Gresik Regency government promulgated the Regional Regulation so that the community can reduce waste generation, including plastic by sorting waste first and not disposing of it carelessly. Based on the background above, the author raises the formulation of the problem: 1). How is the enforcement of administrative sanctions for violators of Article 15 Paragraph (2) Letter C of Gresik Regency Regional Regulation Number 3 of 2021 concerning Reducing the Use of Single-Use Plastics in Gresik Regency? 2). What are the obstacles and efforts in enforcing administrative sanctions for violators of Article 15 Paragraph (2) Letter C of Gresik Regency Regional Regulation Number 3 of 2021 concerning Reducing the Use of Single-Use Plastics in Gresik Regency? Then the writing uses a type of socio-legal research with a sociological juridical approach method whose data material is obtained from interviews, documentation and questionnaires. From the results of the study, it was found that the enforcement of administrative sanctions for violators of Article 15 Paragraph (2) Letter C of Gresik Regency Regional Regulation Number 3 of 2021 concerning Reducing the Use of Single-Use Plastics in Gresik Regency did not work effectively because of all the factors that affect law enforcement, namely legal factors, law enforcement factors, facilities and infrastructure factors, community factors and cultural factors in the community, none of them worked. The factors that hinder the enforcement of administrative sanctions are from statutory factors in the form of Regent Regulations as implementing rules of Gresik Regency Regional Regulation Number 3 of 2021 that have not been promulgated and lack of adequate budget. Meanwhile, the efforts that have been made so far to make the Regional Regulation run effectively are socializing about related regulations and improving facilities and infrastructure for TPS 3R and TP
