Abstract
Pengawasan terhadap peredaran rokok ilegal adalah sebuah proses di dalam menetapkan tolak ukur dari kinerja yang dapat mendukung dalam pencapaian hasil yang sudah di harapkan. Permasalahan dalam penelitian ini diantaranya : (1) Bagaimana Penerapan Pasal 3 Ayat 1 Peraturan Menteri Perindustrian Nomor 64 Tahun 2014 Tentang Pengawasan Dan Pengendalian Usaha Industri Rokok Kota Bekasi (2) Bagaimana kendala yang dihadapi Bea Cukai Bekasi tentang pengawasan peredaran rokok ilegal tanpa cukai di Kota Bekasi (3) Bagaimana Upaya yang dilakukan Bea Cukai Bekasi tentang pengawasan peredaran rokok ilegal tanpa cukai di Kota Bekasi. Penelitian yang digunakan adalah penelitian hukum yang bersifat empiris dengan menerapkan metode pendekatan sosiologis. Pendekatan ini mencakup penggunaan metode empiris yang difokuskan pada aspek sosiologi hukum, termasuk melibatkan penelitian lapangan (field research). Berdasarkan hasil penelitian ini, menunjukan bahwa : (1) Peredaran rokok ilegal tanpa cukai dimulai dari penghasilan bahan baku tembakau oleh petani, dilanjutkan proses produksi di rumah produksi, menghasilkan produk rokok. Selanjutnya, distribusi rokok tersebut dilakukan oleh distributor kepada berbagai toko atau warung. Pasal 3 Ayat 1 Peraturan Menteri Perindustrian Nomor 64/M-IND/PER/7/2014 mewajibkan bagi perusahaan industri rokok untuk memperoleh Izin Usaha Industri (IUI). (2) Kendala ditunjukkan dengan upaya masyarakat mengelak dari jadwal pengawasan dengan alasan konsumsi pribadi guna menghindari kewajiban pajak yang sesuai dengan Pasal 8 ayat 1 Undang-Undang Republik Indonesia Nomor 39 Tahun 2007 (3) Upaya yang dilakukan dalam pengawasan rokok illegal adalah pelatihan personal secara rutin dan melakukan tugas wewenangnya sesuai pasal 33 ayat 1 Undang-undang Nomor 39 tahun 2007 tentang cukai yaitu melakukan pemeriksaan dan penyegelan barang yang terdeteksi kena cukai. Saran dari penelitian ini adalah : (1) Kantor Bea Cukai Bekasi perlu mengonfirmasi ketentuan tindakan pengawasan dan aktif mendorong masyarakat untuk lebih memilih pembelian barang yang memiliki status resmi daripada yang tidak resmi. Hal ini dapat dicapai dengan terus melakukan sosialisasi di berbagai lapisan masyarakat. Bea Cukai juga perlu merumuskan strategi yang dapat meningkatkan efektivitas pengawasan, dengan fokus pada pendekatan yang menyentuh aspek sosiokultural. Pendekatan ini diharapkan dapat menjadi alternatif strategi untuk meningkatkan kesadaran hukum Masyarakat, dengan demikian, diharapkan pengawasan dapat menjadi lebih efektif. (2) Kepada pihak penjual rokok ilegal agar segera menghentikan pola-pola usaha memperjual-belikan rokok ilegal yang tidak sesuai dengan aturan perundangundangan yang berlaku kepada masyarakat.
English Abstract
Supervision of the distribution of illegal cigarettes is a process of setting benchmarks for performance that can support the achievement of expected results. The problems in this research include: (1) What is the reality of the distribution on the ground regarding the circulation of illegal cigarettes without duty in Bekasi City (2) What are the obstacles faced by Bekasi Customs and Excise regarding monitoring the circulation of illegal cigarettes without duty in Bekasi City (3) What efforts are being made? Bekasi Customs and Excise regarding monitoring the distribution of illegal cigarettes without duty in Bekasi City. The research used is empirical legal research using a sociological approach method. This approach includes the use of empirical methods focused on aspects of legal sociology, including involving field research. Based on the results of this research, it shows that: (1) The circulation of illegal cigarettes without customs duties starts from the production of tobacco raw materials by farmers, followed by the production process at the production house, producing cigarette products. Next, the distribution of cigarettes is carried out by distributors to various shops or stalls. Article 3 Paragraph 1 Minister of Industry Regulation Number 64/M-IND/PER/7/2014 requires cigarette industry companies to obtain an Industrial Business License (IUI). (2) Obstacles are indicated by people's efforts to circumvent the monitoring schedule for the reason of personal consumption in order to avoid tax obligations in accordance with Article 8 paragraph 1 of Law of the Republic of Indonesia Number 39 of 2007 (3) Efforts made to control illegal cigarettes are personal training on a regular basis. routine personal duties and carrying out official duties in accordance with article 33 paragraph 1 of Law Number 39 of 2007 concerning customs, namely carrying out inspections and receiving goods that are detected to be subject to excise. Based on the results of this research, it shows that: (1) The circulation of illegal cigarettes without customs duties starts from the production of tobacco raw materials by farmers, followed by the production process at the production house, producing cigarette products.
