Abstract

Penelitian ini berdasarkan permasalahan merek yang terjadi di Kota Mojokerto. Semakin meningkatnya jumlah penduduk dan tuntutan perekenomian serta Gaya hidup masyarakat perkotaan yang semakin modern,fashionable dan mengikuti trend, maka adanya pelaku usaha perdagangan dan perindustrian sangat membantu untuk memenuhi alasan tersebut tetapi dapat menciptakan kenaikan pelanggaran merek dan menurunkan kualitas perdagangan dan perindustrian seperti adanya pelaku usaha di Benteng Pancasila Kota Mojokerto. Dari latar belakang tersebut,rumusan masalahnya: Apa Hambatan ”Implementasi Perlindungan Hukum Terhadap Persamaan Merek Dagang Terkenal ditinjau dari Pasal 83 ayat 1 Undang-Undang No.20 Tahun 2016 Tentang Merek dan Indikasi Geografis Di Benteng Pancasila di Kota Mojokerto dan Apa upaya Implementasi perlindungan Hukum Terhadap Persamaan Merek Dagang Terkenal ditinjau dari Pasal 83 ayat 1 Undang-Undang No.20 Tahun 2016 Tentang Merek dan Indikasi Geografis Di Benteng Pancasila Kota Mojokerto”.Pada penelitian ini, jenis penelitian adalah hukum Yuridis Empiris, mendasarkan penelitian lapangan, pendekatan penelitian Yuridis Sosiologis,mengkaji subyek hukum serta efektivitas berlakunya hukum positif di masyarakat. Berdasarkan hasil penelitian, penulis menemukan jawaban permasalahan, Hambatan dalam implementasi perlindungan merek terhadap Persamaan merek dagang terkenal di Benteng Pancasila Kota Mojokerto adalah Pelaku usaha khususnya Pedagang tidak semua pelaku usaha mempunyai hasil atau barang yang dihasilkan sendiri; Pelaku usaha banyak yang belum memahami pentingnya pendaftaran merek; Pelaku usaha banyak yang belum mengerti adanya fasilitas merek yang diberikan pemerintah secara gratis, adapun yang mengerti akan tetapi tidak mau mendaftarkan mereknya karena alasan tertentu seperti keuntungan, nama, dan lainnya dan terbatasnya kewenangan yang dimiliki penegak hukum Polres Kota Mojokerto akibat tidak adanya laporan dari pemilik merek yang mereknya dipersamakan oleh pihak lain atau menggunakan mereknya tanpa izin karena persamaan merek merupakan delik aduan. Upaya yang telah dilakukan oleh Pemerintah Kota Mojokerto khususnya ”Dinas Perindustrian dan Perdagangan serta Polres Kota Mojokerto dalam mengatasi masalah implementasi perlindungan hukum terhadap Persamaan merek dagang terkenal di Benteng Pancasila Kota Mojokerto tersebut” dalam hal ini adalah dengan cara Melakukan kajian serta koordinasi dengan lembaga dan/atau institusi lain terkait pentingnya pendaftaran merek untuk seluruh pelaku usaha yang ada saat ini serta Meningkatkan kemampuan dan kualitas Sumber Daya Manusia dalam memahami pentingnya perlindungan hukum bagi suatu usaha.

English Abstract

This research is based on brand problems that occur in Mojokerto City. The increasing population and the demands of the economy as well as the lifestyle of urban communities are increasingly modern, fashionable and follow the trend, then the existence of business actors trade and industry is very helpful to meet these reasons but can create an increase in trademark infringement and degrade the quality of trade and industry such as the existence of business actors in Fort Pancasila Mojokerto City. From this background, the formulation of the problem: What are the Obstacles to ”the Implementation of Legal Protection Against Similarities of Famous Trademarks in terms of Article 83 paragraph 1 of Law No.20 of 2016 Concerning Trademarks and Geographical Indications in Fort Pancasila in Mojokerto City and What are the efforts of the Implementation of Legal protection against” Similarities of Famous Trademarks in terms of Article 83 paragraph 1 of Law ”No.20 of 2016 Concerning Trademarks and Geographical Indications in Fort Pancasila Mojokerto City.In this research”, the type of research is Empirical Juridical law, based on field research, Sociological Juridical research approach, examining legal subjects and the effectiveness of the enactment of positive law in society. Based on the results of the research, the authors found the answer to the problem, the obstacles in the implementation of trademark protection against well-known trademark equations in Benteng Pancasila Mojokerto City are business actors, especially traders, not all business actors have their own results or goods produced; Many business actors ”do not understand the importance of trademark registration; Many business actors do not understand” the existence of trademark facilities provided by the government for free, as for those who understand but do not want to register their trademarks for certain reasons such as profit, name, and others and the limited authority of law enforcement Mojokerto City Police due to the absence of reports from trademark owners whose trademarks are falsified by other parties or use their trademarks without permission because the trademark is a complaint offense. Efforts that have been made by the Mojokerto City Government, especially the Department of Industry and Trade and the Mojokerto City Police in overcoming the problems of the implementation of legal protection of well-known trademark equations in Fort Pancasila Mojokerto City in this case is by conducting studies and coordination with other agencies and / or institutions related to the importance of trademark registration for all existing business actors and improve the ability and quality of the source of legal protection
