Abstract

Dalam skripsi ini penulis mengangkat permasalahan mengenai modus operandi praktik prostitusi yang dimana sampai saat ini masalah terkait prostitusi tidak pernah habisnya untuk dibahas. Yang menelatarbelakangi penelitian ini yaitu sampai saat ini masih minim penelitian yang membahas terkait modus operandi yang digunakan PSK (pekerja seks komersil) dalam mendapatkan pelanggan. Ditambah lagi dengan perubahan metode yang dipakai dari metode konvensional/lokalisasi berkembang menjadi via internet melalui aplikasi menjadikan permasalahan prostitusi ini semakin sulit dibendung oleh aparat penegak hukum, dan itu yang terjadi di Kota Malang. Berdasarkan pemaparan permasalahan diatas, rumusan masalah yang diangkat penulis yaitu: 1. Bagaimanakah modus operandi praktik prostitusi yang terjadi di Kota Malang ? 2. Bagaimanakah upaya penanggulangan yang dilakukan oleh Pemerintah Kota Malang dalam memberantas praktik prostitusi yang terjadi di Kota Malang. Terkait menjawab permasalahan diatas, penulis menggunakan jenis penelitian Yuridis Empiris, metode pendekatan yang digunakan adalah Yuridis Sosiologis, jenis dan sumber data terbagi menjadi jenis, sumber primer dan sekunder, teknik yang digunakan dalam memperoleh data adalah wawancara dan studi kepustakaan, dan teknik analisis data penelitian ini menggunakan teknik deskripstif kualitatif. Berdasarkan hasil penelitian yang mana sesuai dengan rumusan masalah serta metode penelitian diatas, penulis menemukan jawaban permasalahan bahwa modus operandi yang digunakan oleh PSK (pekerja seks komersil) di Kota Malang terbagi kedalam dua metode, yakni metode konvensional dengan cara mangkal di pinggir jalan dan metode kedua melalui aplikasi atau disebut sebagai prostitusi online yang dimana PSK (pekerja seks komersil) memanfaatkan aplikasi media sosial yakni Mi Chat, Twiter, dan Facebook dalam mendapatkan pelanggan. Sedangkan dari pihak pemerintah Kota Malang sendiri terkait penegakan hukum prostitusi ini di ambil alih oleh Satuan Polisi Pamong Praja (Satpol PP) Kota Malang mengingat aturan terkait prostitusi diatur dalam Peraturan Daerah Kota Malang Nomor 8 Tahun 2005 Tentang Larangan Tempat Pelacuran dan Perbuatan Cabul.

English Abstract

In this thesis, the author raises the issue regarding the modus operandi of the practice of prostitution, which until now has never run out of issues related to prostitution to be discussed. The background to this research is that so far there has been minimal research discussing the modus operandi/methods used by commercial sex workers (CSWs) in getting customers. Coupled with the change in the method used from the conventional/localization method to via the application, it has made the problem of prostitution difficult to contain by law enforcement officials, and that is what happened in the city of Malang. Based on the explanation of the problems above, the problem formulation raised by the author is: 1. What is the modus operandi of the practice of prostitution that occurs in the city of Malang? 2. What are the countermeasures carried out by the City Government of Malang in eradicating the practice of prostitution that occurs in Malang City. Regarding answering the above problems, the author uses a Juridical Empirical type of research, the approach method used is Juridical Sociology, the types and sources of data are divided into types, primary and secondary sources, the techniques used in obtaining data are interviews and literature studies, and research data analysis techniques This study uses a qualitative descriptive technique. Based on the results of the research which are in accordance with the formulation of the problem and research methods above, the authors found answers to the problem that the modus operandi used by prostitutes (commercial sex workers) in Malang City is divided into two methods, the conventional method by staying on side streets and the method the second is via an application or what is known as online prostitution where commercial sex workers (CSWs) use social media applications, namely MiChat, Twitter and Facebook to get customers. Meanwhile, from the government of Malang City itself, regarding the enforcement of the prostitution law, this was taken over by the Civil Service Police Unit (Satpol PP) of Malang City, considering that prostitution is regulated in Malang City Regional Regulation Number 8 of 2005 concerning Prohibition of Prostitution Places and Obscene Acts.
