Abstract

Pada skripsi ini, penulis mengangkat permasalahan ketidakjelasan norma mengenai pelaksanaan metode penyidikan dengan pembelian terselubung diatur dalam Pasal 79 Undang-Undang Republik Indonesia Nomor 35 Tahun 2009 tentang Narkotika. Dalam hal ini pembelian terselubung sebagai bagian dari metode penyidikan tidak dijelakan lebih lanjut mengenai gambaran pelaksanaannya dalam Undang-Undang. Ketidakjelasan gambaran mengenai penerapan teknik penyidikan ini menyebabkan permasalahan dalam praktik dilapangan terutama terkait dengan adanya celah hukum untuk penegak hukum dalam memperoleh Narkotika untuk dimanfaatkan sendiri. Peneliti melakukan penelitian dengan rumusan masalah yaitu (1) Bagaimana Urgensi Reformulasi Ketentuan Pembelian Terselubung dalam Undang-Undang No. 35 Tahun 2009 tentang Narkotika? (2) Bagaimana Reformulasi Pembelian Terselubung Dalam Tindak Pidana Narkotika Untuk Sistem Hukum Indonesia kedepannya? Kemudian penulis menggunakan metode penelitian yuridis-normatif dengan pendekatan perundang-undangan (Statute Approach), pendekatan konseptual (Conceptual Approach), dan pendekatan perbandingan (Comparative Approach). Penulis mendapatkan hasil penelitian yaitu terdapat urgensi reformulasi ketentuan pembelian terselubung dalam Undang-Undang No. 35 Tahun 2009 tentang Narkotika karena KUHAP tidak secara eksplisit mengatur teknik pembelian terselubung dan masih terdapat beberapa kelemahan mengenai pengaturan mengenai teknik pembelian terselubung tersebut. Oleh karena itu, penulis melakukan perbandingan pengaturan mengenai teknik penyidikan pembelian terselubung antara Indonesia dengan Amerika Serikat dan Inggris.

English Abstract

In this thesis, the author addresses the issue of the ambiguity of norms regarding the implementation of undercover buy investigation methods as regulated in Article 79 of the Republic of Indonesia Law Number 35 of 2009 concerning Narcotics. In this context, undercover purchases, as a part of the investigative method, are not further elaborated on in the law. The lack of clarity regarding the implementation of this investigative technique has led to problems in practice, particularly concerning legal loopholes for law enforcement to acquire narcotics for personal use. The researcher conducts the study with the following research questions: (1) What is the Urgency of Reformulating the Provisions of Undercover Buy in Law No. 35 of 2009 concerning Narcotics? (2) How should the Reformulation of Undercover Purchases in Narcotics Offenses be for the Indonesian Legal System in the future? The author employs a juridical-normative research method with statutory, conceptual, and comparative approaches. The research findings indicate the urgency of reformulating the provisions of undercover purchases in Law No. 35 of 2009 concerning Narcotics because the Indonesian Criminal Procedure Code (KUHAP) does not explicitly regulate undercover purchase techniques, and there are still several weaknesses in the regulation of these techniques. Therefore, the author conducts a comparison of the regulation of undercover purchase investigative techniques between Indonesia, the United States, and the United Kingdom.
