Abstract
Pada skripsi ini, penulis mengusung masalah terkait Implementasi Tanggung Jawab Pemerintah Indonesia Dalam Pemenuhan Hak-Hak Pekerja Migran Indonesia di Hong Kong Selama Masa Pandemi COVID-19 Berdasarkan Konvensi Buruh Migran 1990. Pemilihan tema ini dilatar belakangi oleh adanya kasus-kasus pelanggaran terhadap hak-hak pekerja migran di Indonesia sepanjang waktu pandemi COVID-19. Dalam hal ini sebagian pekerja migran Indonesia mendapatkan tindakan yang membatasi hak-hak mereka dari para majikan mereka dan kurang puasnya para pekerja migran Indonesia terhadap Pemerintah Indonesia terutama KJRI Hong Kong sebagai wadah mereka mengadu dan penjamin hak-hak mereka selama bekerja di Hong Kong. merujuk pada hal tersebut, penulis mengusung rumusan masalah yakni terkait Bagaimana implementasi tanggung jawab Pemerintah Indonesia dalam pemenuhan hak-hak PMI di Hong Kong selama masa pandemi Covid-19 berdasarkan Konvensi Buruh Migran 1990? Metode penelitian yang diterapkan yakni metode yuridis empiris. Dilakukan dengan cara mewawancarai langsung pihak-pihak terkait, yaitu dua pekerja migran Indonesia yang bertempat di Hong Kong, aktivis sekaligus pemegang jabatan ketua Asosiasi Buruh Migran Internasional, dan KJRI Hong Kong. Disamping itu, dilakukan pula proses pengumpulan data dari hasil referensi buku, jurnal, artikel, dan hukum yang terkait. Berdasarkan hasil penelitian penulis, dalam implementasinya, pemerintah Indonesia secara langsung maupun tidak langsung melewati perwakilannya yaitu KJRI Hong Kong telah melakukan berbagai upaya untuk melaksanakan tanggung jawabnya ini. Beberapa di antaranya adalah melakukan pembagian ribuan masker untuk para PMI, meningkatkan pelayanan dengan tidak menerapkankebijakan6 Work From Home (WFH) dan mengeluarkan beberapa produk hukum untuk mempermudah proses pemulangan PMI. Berdasarkan hasil penelitian yang dilakukan penulis, pemerintah Indonesia kurang optimal dalam mengimplementasikan Konvensi Buruh Migran untuk melindungi pekerja migran Indonesia. Terutama dalam menerapkan pasal 25 poin Ketiga dan Pasal 28 Konvensi Buruh Migran 1990. Terjadi pelanggaran hak-hak para pekerja migran yang seharusnya dijamin untuk dilindungi pemerintah Indonesia dilanggar oleh majikan-majikan mereka. Pemenuhan kebutuhan dasar bagi para pekerja migran Indonesia yang terdampak akibat pandemi COVID-19 oleh pemerintah Indonesia tidak dapat berjalan optimal dikarenakan terkendala beberapa hal. Implementasi hukum Konvensi Buruh Migran memang belum diterapkan dengan baik dan tepat kepada para karyawan migran Indonesia yang bekerja di negara Hong Kong. Oleh karenanya, Pemerintah Indonesia dapat dimintai pertanggungjawabannya untuk merehabilitasi para pekerja migran Indonesia yang mendapatkan perlakuan yang melakukan pelanggaran terhadap hak-hak mereka sebagai pekerja migran dan yang laporannya tidak diselesaikan oleh KJRI Hong Kong. Entah itu dengan ganti rugi berupa materiil maupun pemberian pekerjaan yang lebih layak di dalam maupun luar negeri. Pemerintah Indonesia juga harus mengkaji dan merevisi UU yang berlaku agar hak-hak yang dijamin dan dilindungi menjadi lebih luas dan lebih detail, terutama pada masa-masa yang tidak biasa (irregular).
English Abstract
In this thesis, the author take the issue of Implementation of the Responsibilities of the Indonesian Government in Fulfilling the Rights of Indonesian Migrant Workers in Hong Kong During the COVID-19 Pandemic Based on the 1990 Migrant Workers Convention. The selection of this theme is motivated by cases of violation of the rights of migrant workers in Indonesia during the COVID-19 pandemic. In this case, some Indonesian migrant workers get actions that limit their rights from their employers and the dissatisfaction of Indonesian migrant workers with the Indonesian Government, especially the Indonesian Consulate General in Hong Kong as a place for them to complain and guarantee their rights while working in Hong Kong. According to this explanation, the author raises the problem formulation, namely How is the implementation of the Indonesian Government's responsibility in fulfilling the rights of migrant workers in Hong Kong during the Covid-19 pandemic based on the 1990 Migrant Workers Convention? The method implemented in this research is the empirical juridical method. Conducted by directly interviewing related parties, namely two Indonesian migrant workers residing in Hong Kong, activists as well as the holder of the chairmanship of the International Migrant Workers Association, and the Indonesian Consulate General in Hong Kong. In addition, the author also collects data from books, journals, articles, and related laws. Based on the result, in its implementation, the Indonesian government directly or indirectly through its representative, the Indonesian Consulate General in Hong Kong, has made various efforts to carry out this responsibility. Some of them are distributing thousands of masks to migrant workers, improving services by not implementing the Work From Home (WFH) policy and issuing several legal products to facilitate the repatriation process of migrant workers. According to the results, the Indonesian government is less than optimal in implementing the Migrant Workers Convention to protect Indonesian migrant workers. Especially in implementing article 25 point Three and Article 28 of the 1990 Migrant Workers Convention. There have been violations of the migrant workers right who should be guaranteed to be protected by the Indonesian government violated by their employers. The fulfillment of basic needs for8 Indonesian migrant workers impacted by the COVID-19 pandemic by the Indonesian government cannot run optimally due to several obstacles. The legal implementation of the Migrant Workers Convention has not been applied properly and appropriately to Indonesian migrant workers residing in Hong Kong. Therefore, the Indonesian Government can be held accountable for rehabilitating Indonesian migrant workers who receive treatment that violates their rights as migrant workers and whose reports are not resolved by the Indonesian Consulate General in Hong Kong. Whether it is with material compensation or the provision of more decent work at home or abroad. The Indonesian government should also review and revise the applicable laws so that the rights guaranteed and protected are broader and more detailed, especially during irregular periods.
