Abstract

Imroatin Fauziah, Hukum Administrasi Negara, Fakultas Hukum Universitas Brawijaya, Implementasi Kebijakan Pendataan Penerima Bantuan Langsung Tunai Dana Desa Di Masa Pandemi (Studi Di Desa Sendangrejo Kecamatan Lamongan Kabupaten Lamongan), Luthfi Effendi, S.H., M.Hum., Haru Permadi, S.H., M.H. Penelitian Ini Berdasarkan Pelaksanaan Pendataan Penerima Bantuan Langsung Tunai Dana Desa Di Desa Sendangrejo Kecamatan Lamongan Kabupaten Lamongan. Kebijakan Ini Ada Sebagai Respon Pemerintah Khusus Di Bidang Ekonomi Dalam Keadaan Pandemi. Kebijakan Ini Terkait Dengan Pendataan Yang Dilakukan Untuk Penerima Bantuan Langsung Tunai Dana Desa Yang Menggunakan Acuan Berdasarkan Data Kemiskinan Yang Berasal Dari Kementerian Sosial Dan/ Atau Badan Pusat Statistik. Namun, Berdasarkan Informasi Yang Didapatkan Desa Sendangrejo Melakukan Pendataan Mandiri Dengan Data Yang Tidak Bersumber Dari Kementerian Sosial Dan/ Atau Badan Pusat Statistik. Oleh Karenanya, Dari Latar Belakang Tersebut Maka Rumusan Masalah Yaitu, Mengapa Tidak Menggunakan Data Kementerian Sosial Dan/ Atau Badan Pusat Statistik, Bagaimana Mekanisme Pendataan Penerima Bantuan Langsung Tunai Dana Desa Di Desa Sendangrejo. Penelitian Ini Menggunakan Jenis Penelitian Yuridis Empiris Yaitu Penelitian Hukum Dengan Cara Studi Lapangan, Dengan Menggunakan Pendekatan Yuridis Sosiologis Yaitu Dengan Melihat Kenyataan Hukum Didalam Masyarakat, Dan Menggunakan Teknik Analisis Data Deskriptif Kualitatif. Lokasi Penelitian Yaitu Pada Desa Sendangrejo Kecamatan Lamongan Kabupaten Lamongan. Dari Hasil Penelitian Berdasarkan Rumusan Masalah Diatas Yaitu, Terdapat Beberapa Faktor Yang Menjadi Alasan Megapa Tidak Digunakannya Data Yang Berasal Dari Kementerian Sosial Dan/ Atau Badan Pusat Statistik, Antara Lain Adalah Desa Tidak Hanya Menyalurkan Satu Jenis Bantuan, Permasalahan Data Yang Bersumber Dari Dinas Sosial Dan Badan Pusat Statistik Setempat Dan Mayoritas Sumber Daya Manusia Di Wilayah Setempat. Untuk Mekanisme Atau Prosedur Pendataan Yang Dilakukan Desa Dibantu Oleh Rt/ Rw Setempat Dengan Tahapan- Tahapan Yang Telah Ditetapkan Oleh Pemerintah Desa Setempat

English Abstract

This research is based on the implementation of data collection for Village Fund Direct Cash Assistance recipients in Sendangrejo Village, Lamongan District, Lamongan Regency. This policy exists as a special government response in the economic field during a pandemic. This policy is related to data collection for recipients of the Village Fund Direct Cash Assistance that uses a reference based on poverty data from the Ministry of Social Affairs and/or the Central Statistics Agency. However, based on the information obtained, Sendangrejo Village conducted independent data collection with data not sourced from the Ministry of Social Affairs and/or the Central Statistics Agency. Therefore, from this background, the formulation of the problem is, why not use data from the Ministry of Social Affairs and/or the Central Statistics Agency, how is the mechanism for collecting data on recipients of Village Fund Cash Direct Assistance in Sendangrejo Village. This research uses empirical juridical research, namely legal research by means of field studies, using a sociological juridical approach, namely by looking at the legal reality in society, and using qualitative descriptive data analysis techniques. The research location is in Sendangrejo Village, Lamongan District, Lamongan Regency. From the results of the research based on the formulation of the problem above, there are several factors that are the reason why data from the Ministry of Social Affairs and/or the Central Statistics Agency is not used, among others, is that the village does not only distribute one type of assistance, the problem of data originating from the Social Service and The local Central Statistics Agency and the majority of human resources in the local area. The mechanism or procedure for data collection carried out by the village is assisted by the local RT/ RW with the stages that have been determined by the local village government
