Abstract
Permasalahan alih fungsi lahan menjadi salah satu isu yang ada di tengah masyarakat Indonesia khususnya penduduk Kota Batu. Kota Batu merupakan salah satu ikon wisata yang ada di Jawa Timur. Potensi yang dimiliki Kota Batu dalam sektor pariwisata membuat pembangunan perumahan, tempat wisata, hotel maupun pembangunan lain guna menunjang pariwisata dan kehidupan masyarakat terus meningkat secara signifikan. Meningkatnya pembangunan dan konversi lahan di Kota Batu seiring berjalannya waktu berakibat pada menipisnya lahan di Kota Batu. Berdasarkan data BPS Kota Batu terjadi penurunan luas lahan pertanian yang cukup signifikan, hal ini merupakan dampak dari alih fungsi lahan menjadi pemukiman maupun bangunan lain. Tujuan penelitian ini yaitu untuk mendeskripsikan dan menganalisis proses tata kelola alih fungsi lahan di Kota Batu dalam perspektif environmental governance serta untuk mendeskripsikan dan menganalisis penerapan prinsip-prinsip environmental governance dalam tata kelola alih fungsi lahan di Kota Batu. Jenis penelitian ini menggunakan metode penelitian kualitatif. Teknik pengumpulan data berupa wawancara, observasi, dan dokumentasi.Hasil penelitian menunjukkan bahwa proses tata kelola alih fungsi lahan di Kota Batu dalam perspektif environmental governance belum sempurna. Dapat dilihat dari keempat elemen proses yang masih terdapat kekurangan seperti elemen pembuatan kebijakan yang telah dilakukan sesuai prosedur namun masih kurangnya pelibatan masyarakat. Kedua, pengambilan keputusan dimana terdapat kecenderungan pemerintah yang memihak kepada investor atau swasta. Ketiga, proses negosiasi nilai yang terjadi maladministrasi serta kurangnya transparansi. Keempat, proses resolusi konflik telah dilakukan dengan cukup baik melalui pemberian sanksi terhadap pelanggar serta telah adanya petugas di lapangan seperti Satpol PP. Penerapan prinsip-prinsip environmental governance juga belum sepenuhnya terlaksana, dapat dilihat dalam beberapa prinsip seperti prinsip efektif, prinsip adil, prinsip responsif, dan prinsip kokoh masih terdapat ketidaksesuaian dengan environmental governance atau tata kelola lingkungan yang baik. Saran yang dapat diberikan adalah Pemerintah Kota Batu diharapkan dapat sesegera mungkin merampungkan Perda RTRW terbaru Tahun 2022-2042, dan selanjutnya segera menyusun RDTR supaya dapat mengatur rencana penataan ruang secara detail yang dapat berguna bagi penataan ruang di Kota Batu.
English Abstract
The issue of land conversion became one of the issues among Indonesian people, especially Batu City residents. Batu City is one of the tourist icons in East Java. The potential of the Batu City in the tourism sector make keeps housing, tourist resorts, hotels and other developments that promote tourism and community life steadily increasing. The increase in the building and conversion of land in the Batu City over time resulted in the depletion of land in the Batu City. Based on data from BPS of Batu City, there’s been a significant decline in agricultural land, this is the impact from land function settlement as well as other buildings. The aim of the study is to describe and analyze the process of governance of Batu City land functions in an environmental governance perspective and to describe and analyze the application of environmental governance principles in the governance of Batu City. This type of research employs qualitative research methods. Data collection techniques of interviews, observation, and documentation. Research shows that the governance of Batu City land functions in an environmental governance perspective has been flawed. It can be seen from all four elements that there are still deficiencies such as policymaking elements which has been done according to procedure but still lack of civic encroaching. Second, decision-making is where governments tend to favor investors or private investors. Third, the value negotiation process that occurs with maladministration and lack of transparency. Fourth, the conflict resolution process has been carried out quite well through disciplinary action against offenders and by the way officers are in the field like the Satpol PP. Then the application of environmental governance principles has not been fully realized, it can be seen in some principles such as effective principles, fair principles, responsive principles, and substantial principles that remain in conflict with good environmental governance or environmental governance. The suggestion might be given is that the Batu City Government will be able to finalize the latest RTRW Perda for 2022-2042 as soon as possible, and then immediately prepare the RDTR so that it can regulate detailed spatial planning plans that can be useful for spatial planning in Batu City.
