Abstract

Pada skripsi ini, penulis mengangkat permasalahan ini dilatar belakangi oleh adanya tindakan dari pemerintah Republik Rakyat Cina yang menahan masuknya salah satu tim dari WHO yang akan melakukan penelitian untuk kasus COVID-19 dikarenakan masalah visa. Berdasarkan penjelasan tersebut, karya tulis ini mengangkat rumusan masalah: (1) Bagaimana status hukum tim penyelidik COVID-19 bentukan WHO dalam perspektif Hukum Internasional? (2) Apa Saja perlindungan hukum yang didapatkan oleh Tim Penyelidik COVID-19 bentukan WHO berdasarkan Hukum Internasional? Kemudian pada penulisan karya tulis ini menggunakan metode yuridis normatif dengan metode pendekatan perundang-undangan yaitu aturan hukum internasional (statute approach) dan pendekatan kasus (case approach). Dari hasil penelitian ini, penulis memperoleh jawaban atas permasalahan yang ada bahwa Kedudukan Tim Penyelidik COVID-19 bentukan WHO disini merupakan alat pelengkap dalam Organisasi Internasional yang dianggap membawa atau mewakili Organisasi Internasional melaksanakan hak dan tanggung jawabnya di dunia internasional. Convention on The Privileges and Immunities of the Specialized Agencies (Konvensi Hak Istimewa dan Kekebalan Lembaga Khusus PBB) telah mengatur perlindungan hukum bagi Experts on Mission, namun hanya saat mereka telah berada di dalam negara dimana mereka menjalani misinya, sedangkan peraturan yang melindungi mereka pada saat sebelum menjalani misinya terlihat tidak ada. Sehingga perlunya perlindungan hukum bagi Tim Penyelidik COVID-19 bentukan WHO ini.

English Abstract

In this thesis, the author raises this issue against the background of the action of the government of the People's Republic of China which prevented the entry of one of the teams from WHO who would conduct research for COVID-19 cases due to visa problems. Based on the above, this paper raises the formulation of the problem: (1) What is the legal status of the COVID-19 investigation team formed by WHO in the perspective of International Law? (2) What are the legal protections obtained by the WHO's COVID-19 Investigation Team based on International Law? Then the writing of this paper uses a normative juridical method with a statutory approach, namely the rule of international law (statute approach) and a case approach. From the results of this study, the authors obtain answers to existing problems that the position of the WHO COVID-19 Investigation Team here is a complementary tool in International Organizations that are considered to carry or represent International Organizations carrying out their rights and responsibilities in the international world. The Convention on The Privileges and Immunities of the Specialized Agencies has regulated legal protection for Experts on Mission, but only when they are already in the country where they are carrying out their mission, while the regulations that protect them before carrying out their mission appear to be non-existent. So that there is a need for legal protection for the COVID-19 Investigation Team formed by WHO.
