Abstract

umumnya suksesi pemerintahan suatu negara diatur dalam konstitusi negara tersebut. Taliban berhasil menguasai mayoritas wilayah Afghanistan sehingga membuat Presiden Ashraf Ghani memutuskan untuk meninggalkan Afghanistan sehingga tidak ada yang mengisi kekuasaan Afghanistan pada saat itu. Dalam hal iv ini Taliban bisa dikatakan sebagai pemegang kekuasaan tertinggi yang sah di Afghanistan. Dalam hukum internasional sendiri juga terdapat prinsip non intervensi, yang mana melarang negara-negara untuk mencampuri urusan dalam negeri negara lain. Ada atau tidaknya pengakuan dari negara lain sebenarnya tidak berpengaruh pada kenyataan bahwa pemegang kekuasaan Afghanistan adalah Taliban maupun eksistensi negara Afghanistan itu sendiri. Sebuah pengakuan tidaklah menjadi syarat yang utama atau syarat konstitusional bagi suatu negara atau pemerintahan suatu negara, melainkan hanya sebagai pelengkap yang bersifat deklaratif dari negara lain bahwa suatu negara atau pemerintahan telah diterima dalam masyarakat internasional

English Abstract

In this thesis the author raises the issue of Succession of the Afghan Government according to International Law. The choice of the issue was motivated by the takeover of the Afghan government by the Taliban armed group. The United States agreed to end the 20-year armed conflict in Afghanistan by withdrawing all its troops and allies from Afghanistan. This is certainly a concern for the international community because the Taliban itself is known as one of the armed groups that often violates human rights. Based on the things that have been explained previously, this paper raises the formulation of the problem: (1) How is the succession of the Afghanistan’s government according to international law? (2) How is the succession of the Afghanistan’s government when it is not recognized by other countries? Then the writing of this thesis uses a normative juridical method with a statute approach and a conceptual approach. Researchers will examine legal materials in the form of international agreements or other sources of international law and conduct a literature study in the form of literature books, journals and articles related to the issues raised in this research, so that they will answer the problems that arise in this research. From the results of the research using the method above, the authors obtain answers to the existing problems that international law basically does not regulate the succession of government that occurs in a country. In general, the succession of government of a country is regulated in the constitution of that country. The Taliban managed to control the majority of Afghanistan, so that President Ashraf Ghani decided to leave Afghanistan so there is no one who held the power in Afghanistan's at that time. In this case the Taliban can be said to be the highest legitimate power holder in Afghanistan. In international law itself there is also the principle of non-intervention, which prohibits states from interfering in the internal affairs of other countries. The presence or absence of recognition from other countries actually has no effect on the fact that the holders of power in Afghanistan are the Taliban or the existence of the Afghan state itself. A recognition is not the main requirement or constitutional requirement for a country or the government of a country, but only as a declarative complement from other countries that a country or government has been accepted in the international community.
