Abstract

Pada skripsi ini, penulis mengangkat permasalahan Efektivitas Peraturan Menteri Dalam Negeri Nomor 2 Tahun 2016 Tentang Kartu Identitas Anak. Pilihan judul ini dilatar belakangi kesadaran hukum dalam masyarakat masih terbilang kurang, serta masih kurangnya peran dari penegak hukum baik dari segi informasi maupun dari aturannya sendiri, dimana apabila hukumnya masih belum efektif, maka akan memberikan dampak terhadap penerapannya. Berdasarkan latar belakang di atas penulis mengangkat rumusan masalah : (1) Mengapa pelaksanaan Peraturan Menteri Dalam Negeri Nomor 2 Tahun 2016 Tentang Kartu Identitas Anak terhadap penerbitan KIA di Desa Selopuro belum efektif? (2) Apa kendala dan juga upaya dalam efektivitas pelaksanaan Peraturan Menteri Dalam Negeri Nomor 2 Tahun 2016 Tentang Kartu Identitas Anak terhadap penerbitan KIA di Desa Selopuro? Kemudian penulisan karya tulis ini menggunakan metode sosio legal dengan metode pendekatan yuridis sosiologis. Data primer, data sekunder yang diperoleh oleh penulis akan dianalisis dengan menggunakan metode deskriptif kualitatif. Data tersebut dikaji dan dianalisis dengan menguraikan dan memaparkan secara jelas mengenai objek yang diteliti, serta dikaitkan dengan teori dan peraturan yang berlaku yang bertujuan untuk memecahkan permasalahan yang diangkat. Dari hasil penelitian dengan metode di atas, penulis memperoleh jawaban atas permasalahan yang ada bahwa faktor yang dapat memengaruhi efektivitas pelaksanaan Peraturan Menteri Dalam Negeri Nomor 2 Tahun 2016 Tentang Kartu Identitas Anak terhadap penerbitan KIA di Desa Selopuro diantaranya adalah faktor hukum, faktor penegak hukum, faktor sarana atau fasilitas pendukung, faktor masyarakat, dan faktor budaya masyarakat. Dimana terdapat beberapa kendala yang menyebabkan tidak efektifnya aturan tersebut yaitu pada faktor hukum, aturan tersebut masih mempunyai kelemahan dalam pengaturan kewajiban untuk memiliki KIA. Faktor penegak hukum yaitu dimana belum melakukan sosialisasi dan inovasi secara merata. Faktor masyarakat dikarenakan masyarakat masih mempunyai kesadaran hukum yang rendah. Pemerintah sedang melakukan upaya berupa mewujudkan kerja sama di bidang kesehatan dan juga bidang pendidikan untuk menunjang pemanfaatan KIA, melakukan sosialisasi pada lembaga tertentu dengan maksud supaya dapat menunjang pemahaman masyarakat. Upaya lainnya yang akan dilakukan yaitu mengkomunikasikan program tersebut dengan baik dan konsisten.

English Abstract

In this thesis, the author raises the issue of the Effectiveness of the Minister of Home Affairs Regulation Number 2 of 2016 concerning Child Identity Cards. The choice of this title is motivated by the lack of legal awareness in society, as well as the lack of role of law enforcement both in terms of information and the rules themselves, where if the law is still not effective, it will have an impact on its application. Based on the above background the author raises the formulation of the problem: (1) Why has the implementation of the Minister of Home Affairs Regulation No. 2/2016 on Child Identity Cards on the issuance of KIA in Selopuro Village not been effective? (2) What are the obstacles and efforts in the effectiveness of the implementation of the Regulation of the Minister of Home Affairs Number 2 of 2016 concerning Child Identity Cards on the issuance of KIA in Selopuro Village? Then the writing of this paper uses a socio-legal method with a sociological juridical approach. Primary data, secondary data obtained by the author will be analysed using qualitative descriptive method. The data is studied and analysed by describing and explaining clearly about the object under study, and is associated with the applicable theories and regulations that aim to solve the problems raised. From the results of research with the above methods, the authors obtained answers to existing problems that factors that can affect the effectiveness of the implementation of the Minister of Home Affairs Regulation Number 2 of 2016 concerning Child Identity Cards on the issuance of KIA in Selopuro Village include legal factors, law enforcement factors, supporting facilities or facilities, community factors, and community cultural factors. Where there are several obstacles that cause the ineffectiveness of the regulation, namely in legal factors, the regulation still has weaknesses in regulating the obligation to have KIA. The law enforcement factor is where it has not conducted socialisation and innovation evenly. The community factor is because the community still has low legal awareness. The government is making efforts in the form of realising cooperation in the health sector and also in the education sector to support the use of KIA, conducting socialisation at certain institutions with the intention of supporting public understanding. Other efforts that will be made are communicating the programme well and consistently.
