Abstract
Pada penulisan penelitian ini, penulis mengangkat permasalahan Larangan Mengais Sampah di Tempat Penampungan Sementara. Pilihan tema tersebut dilatar belakangi oleh masih banyak dijumpainya pemulung yang mengais sampah di Tempat Penampungan Sementara (TPS) di Kabupaten Sragen. Dimana di dalam kegiatannya mengais sampah seringkali menyebabkan sampah menjadi berserakan dimana-mana. Kegiatan mengais sampah tersebut melanggar norma hukum dalam Pasal 40 huruf g Peraturan Daerah Kabupaten Sragen Nomor 3 Tahun 2014 tentang Pengelolaan Sampah. Berdasarkan permasalahan tersebut, maka rumusan masalah pada penelitian ini mengenai: (1) Bagaimana efektivitas larangan mengais sampah di tempat penampungan sementara pada Pasal 40 huruf g Peraturan Daerah Kabupaten Sragen Nomor 3 Tahun 2014 tentang Pengelolaan Sampah? (2) Faktor- faktor apa yang menghambat efektivitas larangan mengais sampah di tempat penampungan sementara pada Pasal 40 huruf g Peraturan Daerah Kabupaten Sragen Nomor 3 Tahun 2014 tentang Pengelolaan Sampah dan solusinya yang dilakukan oleh Pemerintahan Kabupaten Sragen? Kemudian penulisan karya tulis ini menggunakan metode sosio legal dengan metode pendekatan yuridis sosiologis. Lokasi penelitian dilaksanakan di Dinas Lingkungan Hidup Kabupaten Sragen, Satuan Polisi Pamong Praja Kabupaten Sragen, dan Tempat Penampungan Sampah Sementara (TPS) di Kabupaten Sragen. Jenis data yang digunakan adalah data primer yang bersumber dari hasil wawancara dan observasi langsung dari lokasi penelitian, serta data sekunder yang bersumber dari arsip data dari lokasi penelitian, situs resmi pemerintahan Kabupaten Sragen, studi kepustakaan maupun peraturan perundang-undang yang terkait. Teknik analisis data dengan menggunakan metode deskriptif kualitatif. Dari hasil penelitian dengan metode di atas, penulis memperoleh jawaban atas permasalahan yang ada bahwa Larangan Mengais Sampah di Tempat Penampungan Sementara (Studi Efektivitas Pasal 40 huruf g Peraturan Daerah Kabupaten Sragen Nomor 3 Tahun 2014 tentang Pengelolaan Sampah) belum efektif. Faktor-faktor yang menghambatnya setelah dilakukan analisis dengan menggunakan teori Soerjono Soekanto, yaitu dari faktor hukumnya, faktor penegak hukum, faktor sarana dan prasarana, faktor dari masyarakat, dan faktor kebudayaan. Adapun solusi yang dilakukan oleh Dinas Lingkungan Hidup Kabupaten Sragen adalah menjadikan pemulung sebagai rekan kerja untuk mengurangi sampah yang akan dibawa ke Tempat Pembuangan Akhir (TPA) Tanggan, Kabupaten Sragen; mengevaluasi kegiatan mengais sampah agar kegiatannya tidak menyebabkan sampah menjadi berserakan kemana-mana dan tidak mengganggu terkait operasional alat berat pengelolaan sampah
English Abstract
In conducting this research, the authors raised the issue of the prohibition of scavenging garbage in temporary shelters. The background of this theme choice is that there are still many scavengers who scavenge garbage at temporary shelters (TPS) in Sragen Regency, where theis activities often cause garbage to be scattered everywhere. The scavenging activity violates legal norms in Article 40 letter g of the Sragen Regency Regional Regulation Number 3 of 2014 concerning waste management. Based on these problems, the formulation of the problem in this study concerns: (1) How effective is the ban on scavenging waste in temporary shelters in Article 40 letter g of Sragen Regency Regional Regulation Number 3 of 2014 concerning waste management? (2) What factors impede the effectiveness of the ban on scavenging garbage in temporary shelters in Article 40 letter g of the Sragen Regency Regional Regulation Number 3 of 2014 concerning waste management and the solution carried out by the Sragen Regency Government? Then the writing of this paper uses the socio-legal method with the sociological-juridical approach. The research locations were carried out at the Sragen Regency Environmental Service, the Civil Service Police Unit of Sragen Regency, and the Temporary Waste Storage Site (TPS) in Sragen Regency. The type of data used is primary data that comes from interviews and direct observation from the research location, as well as secondary data that comes from data archives from the research locations, the official website of the Sragen Regency government, literature studies, and related laws and regulations. Data analysis techniques using descriptive and qualitative methods. From the results of the research using the above method, the authors obtained answers to the existing problems that the Prohibition of Scavenging Waste in Temporary Shelters (Study of the Effectiveness of Article 40 letter g of Sragen Regency Regional Regulation Number 3 of 2014 concerning Waste Management) has not been effective. After analyzing the factors that hindered it using Soerjono Soekanto's theory, namely the legal factors, law enforcement factors, facilities and infrastructure factors, community factors, and cultural factors. The solution implemented by the Sragen Regency Environmental Service is to make scavengers work as partners to reduce waste that will be taken to the Tangan Final Disposal Site (TPA), Sragen Regency; evaluate the activity of scavenging garbage so that its activities do not cause waste to be scattered everywhere and do not interfere with the operation of heavy equipment for waste management.
