Abstract

Dalam skripsi ini penulis membahas tentang penyelesaian tindak pidana narkotika melalui keadilan restoratif pada tahap penyidikan. Hal tersebut telah diatur dalam Peraturan Kepolisian Negara Republik Indonesia Nomor 8 Tahun 2021 tentang Penanganan Tindak Pidana Berdasarkan Keadilan Restoratif. Pelaku tindak pidana narkotika seperti pecandu atau korban penyalahgunaan narkotika dapat diselesaikan melalui restorative justice dengan mendapatkan kesempatan untuk dilakukan rehabilitasi medis ataupun sosial tanpa harus menunggu putusan dari pengadilan. Penelitian ini bertujuan untuk memperoleh pemahaman dan melakukan analisa mengenai dasar-dasar yang menjadi bahan pertimbangan oleh pihak kepolisian dalam menangani pelaku tindak pidana narkotika melalui restorative justice. Dalam mengambil pertimbangan ini tentunya harus dilakukan dengan hati-hati dan juga selektif mengingat bahwa narkotika merupakan salah satu bentuk kejahatan luar biasa, sehingga dalam mengambil pertimbangan tersebut nantinya dapat mewujudkan adanya kemanfaatan dan keadilan hukum. Dalam penulisan skripsi ini penulis menggunakan metode penelitian sosio legal dengan menggunakan metode pendekatan sosiologi hukum. Bahan primer yang diperoleh yaitu melalui teknik wawancara. Bahan sekunder yang digunakan melalui studi kepustakaan diantaranya menggunakan skripsi terdahulu, jurnal dan juga pencarian sumber dari internet. Kemudian dari bahan primer dan sekunder tersebut penulis akan melakukan pengolahan data dengan menggunakan teknik deskriptif kualitatif. Berdasarkan dari hasil penelitian, penulis menemukan jawaban terkait penerapan restorative justice yang diberlakukan terhadap pelaku tindak pidana narkotika pada tahap penyidikan melalui Asesmen Terpadu yang dilakukan oleh Tim Asesmen Terpadu.

English Abstract

In this thesis, the author discusses the settlement of narcotics crimes through restorative justice at the investigation stage. This has been regulated in the Regulation of the State Police of the Republic of Indonesia Number 8 of 2021 concerning Handling of Crimes Based on Restorative Justice. Perpetrators of narcotics crimes such as addicts or victims of narcotics abuse can be resolved through restorative justice by getting the opportunity to undergo medical or social rehabilitation without having to wait for a decision from the court. This study aims to gain an understanding and conduct an analysis of the basics that are taken into consideration by the police in dealing with drug offenders through restorative justice. In taking this consideration, of course, it must be carried out carefully and also selectively, bearing in mind that narcotics are a form of extraordinary crime, so that in taking these considerations later it can realize legal benefits and justice. In writing this thesis, the writer uses the socio-legal research method using the legal sociology approach. The primary material obtained is through interview techniques. Secondary materials used through library research include using previous theses, journals and also searching for sources from the internet. Then, from the primary and secondary materials, the writer will process the data using qualitative descriptive techniques. Based on the results of the research, the authors found answers regarding the application of restorative justice that was applied to perpetrators of narcotics crimes at the investigation stage through the Integrated Assessment conducted by the Integrated Assessment Team
