Abstract

Pada penelitian ini, penulis mengangkat permasalahan mengenai tidak adanya perlindungan hukum kepada para pekerja di dalam hubungan kerja non-standar di Indonesia. Permasalahan ini dilatar belakangi dengan kurang sempurnanya pengaturan mengenai perlindungan hukum pekerja/buruh sehingga dikhawatirkan dapat menjadi kesempatan bagi pemberi kerja dalam menghindari hak dan kewajiban hukum tertentu. Dalam Undang-Undang No. 13 tahun 2003 Tentang Ketenagakerjaan dan UU Cipta Kerja di Indonesia hanya mengatur terkait Temporary Employment sebagai PKWT dan Multy-Party Employment sebagai alih daya. Sedangkan untuk jenis Part-time and on-call work dan Disguised/Dependent self-employment tidak ada regulasi yang mengaturnya. Artinya pekerja dalam hubungan kerja non-standar Part- time and on-call work dan Disguised/Dependent self-employment berada pada posisi rentan karena tidak diperlakukan sama dengan pekerja lainnya. Sementara praktek perusahaan menggunakan jenis hubungan kerja non-standar ini telah banyak dilakukan perusahaan di Indonesia. Berdasarkan hal tesebut, maka rumusan masalah yang dikemukakan dalam penelitian ini adalah Bagaimana pengaturan terhadap hubungan kerja non-standar di Indonesia? Untuk menjawab rumusan masalah di atas, penelitian hukum yuridis ini menggunakan pendekatan perundang-undangan, pendekatan konseptual, pendekatan perbandingan. Bahan hukum yang digunakan dalam penelitian ini adalah bahan hukum primer, bahan hukum sekunder, dan bahan hukum tersier yang ketiga bahan tersebut diperoleh melalui studi kepustakaan serta internet. Bahan hukum yang telah diperoleh kemudian dianalisis dengan beberapa teknik yaitu interpretasi gramatikal, interpretasi sistematis, dan argumentum per analogiam untuk mendapatkan jawaban atas masalah hukum yang telah dirumuskan. Berdasarkan pembahasan, diperoleh hasil bahwa dibalik ketidak sempurnaan pengaturan perlindungan pekerja dalam hubungan kerja non-standar di Indonesia, terdapat 2 jenis hubungan kerja non-standar yang sudah diregulasi dengan pengaturan perundang-undangan yaitu Temporary Employment dan Multy-Party Employment. Sedangkan jenis Part-time and on-call work dan Disguised/Dependent self-employment tidak terdapat regulasi yang mengaturnya. Penulis selanjutnya merumuskan konstruksi pengaturan mengenai perlindungan pekerja pada jenis Part- time and on-call work dan Disguised/Dependent self-employment. Dimana dalam konstruksi tersebut penulis menggunakan pendekatan studi komparatif dengan pengaturan mengenai pekerja dalam jenis Part-time and on-call work dan Disguised/Dependent self-employment dengan negara Vietnam dan Jepang dan berdasarkan konvensi ILO mengenai pekerja paruh waktu.

English Abstract

In this study, the authors raise the issue of the lack of legal protection for workers in non-standard employment relationships in Indonesia. This problem is motivated by imperfect regulations regarding the legal protection of workers/laborers so that it is feared that this could become an opportunity for employers to avoid certain legal rights and obligations. In Law no. 13 of 2003 concerning Employment and the Job Creation Law in Indonesia only regulates Temporary Employment as PKWT and Multi- Party Employment as outsourcing. As for the types of Part-time and on-call work and Disguised/Dependent self-employment, there are no regulations governing them. This means that workers in non-standard work relationships Part-time and on-call work and Disguised/Dependent self-employment are in a vulnerable position because they are not treated the same as other workers. While the practice of companies using this type of non-standard employment relationship has been carried out by many companies in Indonesia. Based on this, the formulation of the problem raised in this study is How are non-standard employment relations regulated in Indonesia? To answer the formulation of the problem above, this normative juridical law research uses statutory approaches, conceptual approaches, comparative approaches. The legal materials used in this study are primary legal materials, secondary legal materials, and tertiary legal materials, the three materials obtained through library research and the internet. The legal material that has been obtained is then analyzed using several techniques, namely grammatical interpretation, systematic interpretation, and argumentum per analogyam to get answers to the legal problems that have been formulated. Based on the discussion, it was found that behind the imperfect regulation of worker protection in non-standard employment relations in Indonesia, there are 2 types of non-standard employment relations that have been regulated by statutory arrangements, namely Temporary Employment and Multi-Party Employment. Meanwhile, there are no regulations governing the types of Part-time and on-call work and Disguised/Dependent self-employment. The author then formulates regulatory constructions regarding worker protection in the types of Part-time and on-call work and Disguised/Dependent self-employment. Where in this construction the author uses a comparative study approach with arrangements regarding workers in the type of Part-time and on-call work and Disguised/Dependent self-employment with Vietnam and Japan and based on ILO conventions regarding part-time workers
