Abstract
Pada skripsi ini penulis mengangkat permasalahan pemenuhan hak atas akses fasilitas publik bagi penyandang disabilitas di sektor layanan kesehatan bagi penyandang disabilitas di kabupaten tulungagung. Pilihan temq tersebut dilatarbelakangi oleh HAM yang sejatinya memiliki sifat yang universal namun masih terdapat beberapa kelompok yang belum terpenuhi hak asasinya, termasuk penyandang disabilitas, penyandang disabilitas dalam menjalankan kehidupan sehari-harinya mengalami hambatan dikarenakan keterbatasan-keterbatasannya, oleh karena itu mereka memerlukan fasilitas-fasilitas untuk menunjang kehidupan nya sehari-hari agar hak nya dapat terpenuhi sebagaimana mestinya. Semua orang pasti pernah berurusan dengan masalah kesehatan, pada suatu kondisi ketika kita merasa sakit kita memerlukan perawatan lebih lanjut melalui fasilitas pelayanan kesehatan, sama halnya dengan penyandang disabilitas, namun perbedaannya, penyandang disabilitas mengalami hambatan dalam mengakses fasilitas pelayanan kesehatan. Kabupaten tulungagung sendiri belum memiliki peraturan daerah yang mengatur tentang pemenuhan penyandang disabilitas dan salah satu rumah sakit di kabupaten tulungagung pada tahun 2019 dinobatkan sebagai rumah sakit terbaik di dunia. Berdasarkan hal tersebut diatas, karya tulis ini mengangkat rumusan masalah: 1) bagaimanakan implementasi pemenuhan akses fasilitas publikcdi sektor layanan kesehatan bagi penyandang disabilitas di kabupaten tulungagung? 2) apa saja hambatan-hambatan yang dihadapi pemerintah daerah kabupaten tulungagung dalam pemenuhan akses fasilitas publik di sektor layanan kesehatan bagi penyandang disabilitas di kabupaten tulungagung? 4 Kemudian penulisan karya tulis ini menggunakan metode hukum empiris dengan pendekatan yuridis sosiologis, bahan hukum didapatkan melalui wawancara dan observasi yang akan di analisis dengan menggunakan metode deskriptif analitis. Sampling diperoleh dengan cara purposive sampling. Dari hasil penelitian dengan metode di atas, penulis memperloeh jawaban atas permasalahan yang ada bahwa pusat layanan kesehatan dikabupaten tulungagung belum dapat memenuhi fasilitas-fasilitas yang dibutuhkan oleh penyandang disabilitas , dan terdapat tiga hambatan dalam pemenuhannya , yaitu secara regulasi, perilaku, dan juga sumber daya
English Abstract
n this thesis the author raises the issue of fulfilling the right to access public facilities for persons with disabilities in the health care sector for persons with disabilities in Tulungagung district. The choice of temq is motivated by human rights which actually have a universal nature but there are still some groups whose human rights have not been fulfilled, including persons with disabilities, persons with disabilities in carrying out their daily lives experience obstacles due to their limitations, therefore they need facilities to support his daily life so that his rights can be fulfilled properly. Everyone must have dealt with health problems, in a condition when we feel sick we need further treatment through health care facilities, the same as people with disabilities, but the difference is, people with disabilities experience obstacles in accessing health care facilities. Tulungagung Regency itself does not yet have a regional regulation that regulates the fulfillment of persons with disabilities and one of the hospitals in Tulungagung Regency in 2019 was named the best hospital in the world. Based on the above, this paper raises the formulation of the problem: 1) how is the implementation of fulfilling access to public facilities in the health care sector for persons with disabilities in Tulungagung district? 2) what are the obstacles faced by the local government of Tulungagung Regency in fulfilling access to public facilities in the health care sector for persons with disabilities in Tulungagung Regency? Then the writing of this paper uses the empirical legal method with a sociological juridical approach, the legal material is obtained through interviews and observations which will be analyzed using descriptive analytical methods. Sampling was obtained by means of purposive sampling. From the results of the research using the above method, the authors obtained answers to the existing problems that the health service center in Tulungagung district has not been able to fulfill the facilities needed by persons with disabilities, and there are three obstacles in their fulfillment, namely regulation, behavior, and also resources
