Abstract

Dalam penulisan skripsi ini, penulis mengangkat tema Penanganan Kredit Bermasalah Dengan Cara Relaksasi Kredit Yang Di Akibatkan Oleh Adanya Pandemi Covid-19. Pada masa pandemi COVID-19 banyak sekali kendala-kendala yang dialami debitur dalam pemenuhan kreditnya terhadap pihak bank yang bersangkutan. Salah satu faktor debitur tidak dapat melakukan pembayaran angsuran ialah menurunnya pendapatan, keluarnya kebijakan pemerintah mengenai Pemberlakuan Pembatasan Kegiatan Masyarakat (PPKM) maka OJK (Otoritas Jasa Keuangan) telah menyiapkan beberapa pengaturan mengenai relaksasi kredit terhadap jangka waktu restrukturisasi hingga batas minimal pemberian kredit. Kebijakan mengenai relaksasi kredit tersebut juga dapat mendukungan pemicu bergerak kembalinya pertumbuhan ekonomi agar kembali pada keadaan semula dalam hal ini dengan adanya relaksasi kredit menjadi upaya penangan kredit bermasalah yang paling ideal pada saat masa pandemi COVID-19. Berdasarkan permasalahan tersebut, maka rumusan masalah dama penulisan skripsi ini adalah: (1) Apa saja hambatan dalam penyelesaian relaksasi kredit di PT. BPR Artha Sejahtera Kota Malang akibat ketidakmampuan debitur dalam pemenuhan perjanjian kredit?, (2)Bagaimana upaya yang dilakukan oleh PT. BPR Artha Sejahtera Kota Malang dalam pelaksanaan penyelesaian relaksasi kredit akibat ketidakmampuan debitur dalam pemenuhan perjanjian kredit? Untuk menjawab permasalahan dalam skripsi ini menggunakan metode penelitian dalam skripsi ini yaitu mengkaji ketentuan hukum yang berlaku serta apa yang terjadi dalam kenyataannya pada masyarakat atau disebut dengan yuridis empiris. Penelitian yuridis empiris adalah implementasi ketentuan hukum normatif berdasarkan kenyataan yang ada pada setiap peristiwa hukum tertentu yang terjadi dalam masyarakat atau penelitian hukum mengenai pemberlakuan. Berdasarkan hasil pembahasan yang telah ditulis maka dapat disimpulkan yaitu : Bahwa dengan adanya program pemerintah mengenai relaksasi kredit yang berdasarkan POJK Nomor 11 Tahun 2020 tentang Stimulus Perekonomian Nasional Sebagai Kebijakan Countercylical Dampak Penyebaran Corona Virus Disease 2019 diharapkan memberikan dampak baik dengan memberikan keringanan bagi debitur yang terkena dampak dari adanya pandemi COVID-19. Akan tetapi dari pelaksanaan relaksasi kredit tidak lepas dari suatu permasalahan yang ada yaitu kurang pahamnya debitur mengenai program pemerintah yaitu relaksasi kredit. Dimana relaksasi kredit tersebut bertujuan untuk meringankan kredit bagi debitur yang terdampak pandemi COVID-19. Sehingga sebagian besar debitur mengira bahwa relaksasi kredit merupakan pembaharuan perjanjian serta uang yang telah mereka berikan sebelumnya untuk membayar angsuran akan lenyap di bank yang bersangkutan.

English Abstract

In this thesis, the author raises the theme of Handling Non-Performing Loans by Relaxing Credit Caused by the Covid-19 Pandemic. During the COVID-19 pandemic, there were many obstacles experienced by debtors in fulfilling their credit to the bank concerned. One of the factors that debtors cannot make installment payments is the decline in income, the issuance of government policies regarding the Enforcement of Restrictions on Community Activities (PPKM), the OJK (Financial Services Authority) has prepared several regulations regarding credit relaxation for the restructuring period up to the minimum credit limit. The policy regarding credit relaxation can also support the trigger for the return of economic growth to return to its original state in this case with credit relaxation being the most ideal effort to handle non-performing loans during the COVID-19 pandemic. Based on these problems, the formulation of the problem in writing this thesis are: (1) What are the obstacles in completing credit relaxation at PT. BPR Artha Sejahtera Malang City due to the inability of the debtor in fulfilling the credit agreement? (2) What are the efforts made by PT. BPR Artha Sejahtera Malang City in implementing the settlement of credit relaxation due to the debtor's inability to fulfill credit agreements?. To answer the problems in this thesis, the research method in this thesis is empirical juridical, or what is called field research, namely examining applicable legal provisions and what happens in reality in society. Empirical juridical research is legal research regarding the enforcement or implementation of normative legal provisions in action on certain legal events that occur in society. Based on the results of the discussion that has been written, it can be concluded that: That the government program regarding credit relaxation based on POJK Number 11 of 2020 concerning National Economic Stimulus as a Countercyclical Policy for the Impact of the Spread of Corona Virus Disease 2019 is expected to have a good impact by providing relief for debtors who are affected by the COVID-19 pandemic. However, the implementation of credit relaxation cannot be separated from an existing problem, namely the lack of understanding of debtors regarding government programs, namely credit relaxation. Where the credit relaxation aims to ease credit for debtors affected by the COVID-19 pandemic. So most debtors think that credit relaxation is a renewal of the agreement and the money they have previously given to pay installments will disappear in the bank concerned.
