Abstract

Pada skripsi ini, penulis membahas permasalahan Urgensi Pengaturan Cyber Espionage dalam Masa Damai Ditinjau dari Hukum Internasional. Pemilihan topik ini dilatarbelakangi oleh banyaknya kasus spionase dalam dunia maya (cyberspace), atau yang sering disebut cyber espionage, di masa damai. Tindakan cyber espionage belum memiliki aturan dalam hukum internasional seperti spionase yang dilakukan di dunia nyata. Hukum internasional yang ada juga hanya mengatur spionase dalam masa perang dan bukan masa damai. Berdasarkan latar belakang tersebut, skripsi ini mengangkat rumusan masalah sebagai berikut: (1) Apakah urgensi pengaturan cyber espionage dalam masa damai menurut hukum internasional? dan (2) Bagaimana konsep pengaturan cyber espionage dalam masa damai menurut hukum internasional? Dalam proses penyusunan skripsi ini, penulis menggunakan jenis penelitian yuridis normatif, dengan tiga jenis pendekatan penelitian yaitu pendekatan perundang-undangan (statute approach), pendekatan konseptual (conceptual approach), dan pendekatan kasus (case approach). Bahan hukum dalam skripsi ini ditelusuri dengan studi kepustakaan (library research), dan analisis yang dilakukan terhadap bahan hukum menggunakan teknik evaluasi. Dari penelitian yang dilakukan, penulis menemukan bahwa urgensi dibentuknya pengaturan terhadap cyber espionage muncul karena dilanggarnya prinsip kedaulatan wilayah, banyaknya kasus yang terjadi, dan adanya kekosongan hukum. Adanya pengaturan dapat menciptakan ketertiban antar negara dalam komunitas internasional. Di dalam peraturan cyber espionage dalam masa damai harus memenuhi aspek-aspek penting seperti definisi dan kriteria, klasifikasi metode cyber espionage, pembahasan tentang tindakan unlawful, dan prinsip due diligence. Untuk economic cyber espionage, beberapa ahli mengusulkan World Trade Organization (WTO) sebagai badan yang memberikan prosedur pengadilan, beserta perjanjian Trade-Related Aspects of Intellectual Property Rights (TRIPS) maupun Konvensi Paris sebagai dasar hukum.

English Abstract

In this thesis, the author discusses the need to regulate peacetime cyber espionage from the perspective of international law. The choice of this topic was motivated by the many cases of espionage in cyberspace, or what is often called cyber espionage, in times of peace. The act of cyber espionage is not yet regulated in international law like espionage carried out in the real world. Existing international law also only regulates espionage in times of war and not peacetime. Based on this background, this thesis raises the formulation of the problem as follows: (1) What is the urgency of regulating cyber espionage in peacetime according to international law? and (2) What is the possible mechanism for regulating cyber espionage in peacetime according to international law? In writing this thesis, the author uses normative juridical research, with three types of approaches, namely the statute approach, the conceptual approach, and the case approach. The legal materials in this thesis are gathered through library research, and analyzed using technical evaluation. From the research conducted, the author found that the urgency of establishingaregulation against cyber espionage arises because of the violation of the principle of territorial sovereignty, the frequency of cases that occur, and the existence ofalegal vacuum.Aregulation in this field could possibly create order and improve relationships between nations. Inaregulation for peacetime cyber espionage there must be important aspects such as definitions and criteria, classification of cyber espionage methods, discussion of unlawful acts, and the principle of due diligence. For economic cyber espionage, international law scholars have previously proposed the World Trade Organization (WTO) asabody that provides court procedures, with either the Trade-Related Aspects of Intellectual Property Rights (TRIPS) agreement or the Paris Convention as the legal basis.
