Abstract
Netralitas Aparatur Sipil Negara adalah setiap pegawai Aparatur Sipil Negara yang tidak berpihak dari segala bentuk pengaruh manapun dan tidak memihak kepada kepentingan siapapun. Bentuk netralitas tersebut dilatar belakangi dengan adanya pelanggaran netralitas pegawai negeri sipil selama periode pemilihan kepala daerah, yang melanggar pasal 4 angka 15 Peraturan Pemerintah Nomor 53 Tahun 2010 dan Peraturan Pemerintah Nomor 42 Tahun 2004. Penelitian hukum ini membahas tentang pengawasan terhadap pelanggaran netralitas PNS yang dilaksanakan oleh Badan Pengawas Pemilu Kabupaten Kediri. Untuk menjawab permasalah tersebut, penelitian hukum ini menggunakan metode yuridis empiris dengan pendekatan yuridis sosiologis. Berdasarkan pembahasan, maka dapat disimpulkan : 1) Pengawasan terhadap pelanggaran netralitas pegawai negeri sipil berdasarkan Pasal 4 Angka 15 Peraturan Pemerintah Nomor 53 tahun 2010 di kabupaten Kediri yang dilakukan oleh Bawaslu terlaksana kurang maksimal. 2) Kendala yang dihadapi Bawaslu kabupaten kediri dalam melaksanakan pengawasan terhadap pelanggaran netralitas pegawai negeri sipil di kabupaten Kediri antara lain terbatasnya wewenang Bawaslu dalam pengawasan intern instansi/badan terkait menjadi kurang maksimal, masih banyaknya PNS dan masyarakat yang kurang paham terkait regulasi netralitas PNS, terbatasnya wewenang Bawaslu dalam penanganan pelanggaran netralitas PNS, dan fasilitas waktu dalam menangani pelanggaran kurang relevan
English Abstract
The neutrality of the State Civil Apparatus is any employee of the State Civil Apparatus who does not side with any form of influence and does not favor the interests of anyone. This form of neutrality is motivated by violations of civil servant neutrality during the regional head election period, which is subject to article 4 number 15 of Government Regulation Number 53 of 2010 and Government Regulation Number 42 of 2004. This legal research discusses the supervision of violations of ASN neutrality carried out by the Kediri Regency Election Supervisory Board. To answer the problem, this legal research uses empirical juridical methods with a sociological juridical approach. Based on the discussion, it can be concluded: 1) Supervision of violations of civil servant neutrality based on article 4 number 15 of government regulation number 53 of 2010 in Kediri district carried out by Bawaslu is not optimal. 2) The obstacles faced by Bawaslu kediri district in carrying out supervision of violations of neutrality of civil servants in Kediri district include the limited authority of Bawaslu in internal supervision of relevant agencies to be less than maximum, there are too many PNS and people who do not understand related to the regulation of PNS neutrality, the limited authority of Bawaslu in handling violations of PNS neutrality, and the time facility in handling violations is less relevant.
