Abstract

Peneliti megangkat permasalahan Tanggung Jawab Negara Kepada Peserta Bpjs Yang Tidak Mampu Membayar Iuran Bpjs Akibat Pandemi Corona Virus Disease 2019 ( Covid-19). Latar belakang pemilihan tema tersebut dikarenakan dengan adanya pandemic Virus COVID-19 berdampak pada perubahan keadaan ekonomi dan tingkat kesejahteraan dalam masyarakat. Hal tersebut menyangkut kepada kemampuan masyarakat yang dalam hal ini Peserta BPJS untuk membayar iuran BPJS guna mendapatkan jaminan kesehatan. Negara dalam hal ini Pemerintah sudah mengeluarkan program bagi peserta BPJS yang tidak mampu membayar iuran BPJS untuk ditetapkan statusnya menjadi Penerima Bantuan Iuran. Namun penetapan tersebut harus melalui keputusan Menteri Sosial yang mana akan terlalu lama apabila direfleksikan dengan kondisi pada saat ini. Kriteria bagi penetapan Penerima Bantuan Iuran juga terdapat pertentangan dan kekaburan dalam peraturan yang mengatur hal tersebut. Berdasarkan hal tersebut, maka perlu dikaji bagaimana tanggung jawab negara dalam mengatasi peserta BPJS yang tidak mampu membayar iuran BPJS akibat Pandemic Virus COVID-19. Berdasarkan hal tersebut, penelitian ini mengangkat rumusan masalah: Bagaimana Tanggungjawab Negara kepada Peserta Bpjs Yang Tidak Mampu Membayar Iuran Bpjs Akibat Pandemi Corona Virus Disease 2019 ( Covid-19) ? dan Bagaimana bentuk perlindungan hukum bagi masyarakat yang tidak mampu membayar iuran BPJS yang disebabkan oleh Pandemi Virus Corona Virus Disease 2019 ( COVID-19) ? Penulisan dalam penelitian ini menggunakan metode yuridis normatif dengan metode pendekatan perundang-undangan ( statute approach). Bahan hukum primer dan sekunder yang diperoleh peneliti dianalisis dengan menggunakan teknik interpretasi sistematis dan teknik interpretasi gramatikal. Peneliti memperoleh jawaban atas permasalahan yang ada bahwa Negara memiliki kewajiban dan tanggung jawab untuk menjamin setiap orang dalam masyarakat untuk mendapatkan jaminan sosial termasuk masyarakat yang dalam hal ini Peserta BPJS yang tidak mampu membayar iuran BPJS juga berhak atas jaminan sosial yang diberikan oleh Negara. Berdasarkan tanggung jawab tersebut, Negara memberikan 2 bentuk perlindungan hukum yaitu perlindungan hukum preventif dan perlindungan represif. Bentuk perlindungan hukum preventif yang diberikan oleh Negara adalah program penetapan Penerima Bantuan Iuran bagi masyarakat yang berstatus fakir miskin dan tidak mampu, sedangkan perlindungan hukum represif akan timbul apabila masyarakat merasa dirugikan akibat suatu Keputusan Tata Usaha Negara. Dengan adanya permasalahan terkait penetapan Penerima Bantuan Iuran yang peneliti nilai akan tidak efektif mengigat adanya Pandemi Virus COVID-19. Maka dapat dilakukan pelimpahan kewenangan pada daerah untuk mempersingkat waktu dan memastikan kondisi masyarakat dengan kriteria Penerima Bantuan Iuran sesua

English Abstract

Researcher raise the issue of State Responsibility to BPJS Participants Who Can Not Afford to Pay BPJS Dues Due to the Corona Virus Disease Pandemic 2019 (Covid-19). The background of the selection of the theme is due to the COVID-19 pandemic impacting on the changing economic situation and the level of welfare in the community. It concerns the ability of the community in this case BPJS Participants to pay BPJS dues in order to get health insurance. The state in this case the Government has issued a program for BPJS participants who cannot afford to pay BPJS dues to be determined as the Recipient of Contribution Assistance. However, the determination must go through the decision of the Minister of Social Affairs which will take too long if it is reflected in the current conditions. The criteria for the decisions of Contribution Assistance Recipients also have conflicts and vagueness in the regulations related to this matter. Based on this, it is necessary to review how the responsibility of the state in overcoming BPJS participants who cannot afford to pay BPJS dues due to the COVID-19 Pandemic Virus. Based on this case, this research raise the highlight of the issue: How is the Responsibility of the State to BPJS Participants Who Can not afford to pay BPJS dues due to the Corona Virus Disease Pandemic 2019 ( Covid-19) ? and What is the form of legal protection for people who cannot afford BPJS dues due to the Coronavirus Virus Disease Pandemic 2019 ( COVID-19) ? The writing of this research uses normative juridical method with the method of statute approach. The primary and secondary legal materials that researcher acquired are analyzed using systematic interpretation technique and grammatical interpretation technique. Researcher obtains answers to the existing problem that the State has an obligation and responsibility to guarantee everyone in the community to get social security including the community in this case BPJS Participants who are unable to pay BPJS dues are also entitled to social security provided by the State. Based on these responsibilities, the State provides 2 forms of legal protection, preventive legal protection and repressive legal protection. The form of preventive legal protection provided by the State is the program of determining the Recipient of Contribution Assistance for people who are poor, while repressive legal protection will arise if the community feels harmed due to a State Administration Decree. With the problem related to the determination of Contribution Assistance Recipients that researcher value will not be effective in avoiding the COVID-19 Virus Pandemic. So it can be done by doing some sort of “delegation of authority” to the regional goverment to shorten the time and ensure the condition of the community with the criteria of Contribution Assistance Recipients align with each other
