Abstract

Penelitian ini menganalisis kesesuaian XUAR Regulation on- DE-Extremification dengan United Nation Convention on The Right of The Child (UNCRC) serta tanggung jawab Pemerintah China dalam menghormati, melindungi, dan memenuhi hak anak-anak kelompok minoritas muslim Uighur, terutama terkait hak Identitas sesuai amanat UNCRC. Penelitian ini bertujuan untuk menganalisis XUAR Regulation on De-Extremification terhadap UNCRC dan mengidentifikasi tanggung jawab China terhadap pemenuhan hak anak sesuai ketentuan UNCRC. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan penelitian statute approach dan historical approach. Hasil penelitian ini menunjukkan bahwa Pasal 9 dalam XUAR Regulation on De-Extremification tidak sesuai dengan ketentuan UNCRC yang menyangkut hak identitas anak yang berkaitan dengan agama, bahasa, dan nama, serta hak anak lainnya. Konsekuensinya, Pemerintah XUAR China melanggar hak anak secara sengaja ( By Commision) melalui tindakan legislatif berupa pembuatan kebijakan yang baik secara langsung maupun tidak langsung mencederai hak anak. Sebagai state party, China terikat untuk mematuhi ketentuan UNCRC, namun, Analisis dalam penelitian ini menunjukkan bahwa tanggung jawab China dalam melindungi, menghormati dan memenuhi hak-hak anak muslim Uighur sebagaimana menjadi kewajibannya, belum dilaksanakan sepenuhnya, terutama di tingkat daerah Xinjiang Autonomous Region. Bentuk tanggung jawab yang dapat diambil oleh China adalah dengan meninjau ulang, merevisi, atau mencabut peraturan dalam XUAR Regulation on De-Extremification yang bertentangan dengan UNCRC, khususnya yang bertentangan dengan pemenuhan hak identitas anak. English Abstract

his study analyzes the legal compliance between XUAR Regulation on De-Extremification with the UN Convention on the Rights of the Child (UNCRC) and the responsibility of the Chinese Government in and respecting, protecting, and fulfilling the rights of children of Uighur Muslim children groups, according to the right of Identity that become a mandate of UNCRC. This study aims to analyze the XUAR Regulation on De-Extremification of the UNCRC and identify Chinese responsibilities towards the fulfillment of children's rights in accordance with UNCRC regulations. This study uses a normative legal research method with a statute approach and historical approach. The results of this study indicate that Article 9 of the XUAR Regulation on De-Extremification is not in accordance with UNCRC provisions concerning children's identity rights related to religion, language and names, as well as other children's rights. As a consequence, the Chinese XUAR Government violates the children's rights intentionally (By Commision) through legislative actions in the form of policy making that either directly or indirectly harms the rights of children. As a state party, China is bound to comply with UNCRC provisions, however, the analysis in this study shows that China's responsibility in protecting, respecting and fulfilling the rights of Uighur Muslim children as its obligation, has not been fully implemented, especially at the Xinjiang Autonomous Region level. The form of responsibility that can be taken by China is to review, revise, or revoke regulations in the XUAR Regulation on De-Extremification that is violate the provision of UNCRC, especially those that are in conflict with the fulfillment of children's identity rights. Another form of responsibility is to create a body for supervision and protection of children's rights based in XUAR as a minority children's area.
