Abstract

Pada skripsi ini, penulis mengangkat Permasalahan Status Hukum Penggunaan Smart Contract Di Bidang Asuransi Bencana Alam Oleh Fintech Asing di Indonesia. Pilihan tema tersebut dilatarbelakangi karena belum adanya pengaturan mengenai persyaratan fintech asing yang beroperasi di Indonesia yang menggunakan sistem smart contract dalam kegiatan perasuransian sehingga menyebabkan fintech asing tersebut ilegal dikarenakan tidak mendaftar dan mendapatkan izin dari Otoritas Jasa Keuangan selain itu pengaturan hukum yang spesifik mengenai asuransi bencana alam khususnya mengenai gempa bumi apalagi yang menggunakan teknologi smart contract yang mana hingga saat ini belum ada aturan hukum yang berkaitan dengan dimungkinkannya pengembangan asuransi bencana alam dengan menggunakan smart. Berdasarkan hal diatas, karya tulis ini mengangkat rumusan masalah : Bagaimana status hukum penggunaan smart contract di bidang asuransi bencana alam oleh fintech asing di Indonesia? Kemudian dalam penelitian ini menggunakan metode yuridis normatif dengan menggunakan metode pendekatan perundang-undangan ( statute approach), pendekatan konseptual ( conseptual Approach), dan pendekatan analitis ( analytical approach), dan pendekatan perbandingan ( comparative approach). Bahan Hukum Primer, Sekunder, dan Tersier yang diperoleh akan dianalisis dengan menggunakan teknik analisis sistematis dan gramatikal. Dari hasil penelitian dengan metode penelitian diatas penulis memperoleh jawaban atas permasalahan yang ada yaitu bahwa penggunaan smart contract di Indonesia diperbolehkan didasarkan oleh asas kebebasan berkontrak selama kontrak yang disusun tidak melanggar batasan undang-undang namun fintech asing yang beroperasi di Indonesia harus berbentuk badan hukum dan melakukan permohonan pencatatatan agar mendapatkan izin dari Otoritas Jasa Keuangan dikarenakan apabila tidak mendapatkan izin dari Otoritas Jasa Keuangan maka dianggap merupakan fintech yang ilegal. Namun terdapat kelemahan dalam Peraturan Otoritas Jasa Keuangan Nomor 13/POJK.02/2018 tentang IKD di Sektor Jasa Keuangan sebagai peraturan yang mendukung smart contract dalam bidang perasuransian terdapat kekurangan dalam peraturan ini tidak adanya persyaratan fintech asing untuk dapat beroperasi di Indonesia dikarenakan berkaitan dengan penetapan kepemilikan saham asing dan penetapan modal asing untuk menjamin adanya kepastian hukum.

English Abstract

n this thesis, the author raises the legal status problem of smart contracts application dealing with natural disaster insurance by foreign Fintech in Indonesia. The choice of the theme is based on the absence of settings on the requirements of foreign fintech operating in Indonesia using smart contract system in insurance activities that cause the foreign fintech is illegal because it does not register and obtain permission from the Financial Services Authority other than that specific legal arrangements regarding natural disaster insurance in particular about the earthquake Earth let alone using Smart contract technology which until now has no legal rule relating to the development of natural disaster insurance by using smart contracts because natural disaster insurance is very important in Indonesia as one of the instruments in the mitigation of natural disasters and as a risk mitigation for the impact of natural disasters. Based on the above, this research raises the problem: How is the legal status of smart contracts application dealing with natural disaster insurance by foreign fintech in Indonesia? Later in this study used the normative juridical method using statute approach, conceptual approach, analytical approach, and comparative approach. Primary, secondary, and tertiary legal substances are analyzed using systematic analytical technique and grammatically analytical technique. This study aims to discuss the legal status of smart contract application dealing with natural disaster insurance by foreign fintech in Indonesia. Based on the discussion, it is concluded that the legal status of smart contract is legally applicable in Indonesia as a manifestation of freedom of contract principle as long as the contracts drawn up do not violate the limitations set by the Law. Thus, foreign fintech utilizing the smart contract system in Indonesia dealing with Natural Disaster Insurance must be in the form of Legal Entity by applying registration to obtain a license for establishment from the Financial Services Authority. It is required that a fintech in Indonesia obtain a license from the Financial Services Authority. Consequently, a fintech without proper registration to Financial Services Authority was considered illegal. However, a weakness point was found in Financial Services Authority Regulation Number 13 / POJK.02 / 2018 regarding Digital Financial Innovation in the Financial Services Sector (as a regulation that supports smart contracts in the insurance sector), which was the absence of foreign fintech requirements to operate in Indonesia, thus it relates to the determination of foreign share ownership and determination of foreign capital ownership to guarantee legal certaintity
