Abstract

Pemerintah menerapkan aturan mengenai pengendalian IMEI (International Mobile Equipment Identity). Hal ini dilakukan untuk memberantas peredaran HKT (Handphone, Komputer Genggam dan Tablet) secara ilegal karena telah merugikan negara. Masyarakat yang membeli jenis barang HKT wajib melakukan pendaftaran IMEI agar operator seluler tidak diblokir oleh pemerintah. Tujuan dari penelitian ini adalah : (1) Untuk mengetahui dan menganalisis perlunya melakukan pendaftaran IMEI, (2) Untuk mengetahui dan menganalisis proses atau prosedur pendaftaran IMEI, (3) Untuk mengetahui dan menganalisis upaya yang dilakukan KPPBC TMC Malang untuk mengurangi penyelundupan barang impor atas barang HKT. Hasil penelitian ini memberikan fakta bahwa peraturan terkait pendaftaran IMEI, pemerintah ingin melindungi masyarakat dan juga konsumen atas jenis barang HKT dalam membeli dan menggunakan perangkat yang legal dan memberikan kepastian hukum kepada operator dalam menyambungkan jaringan telekomunikasi atas jenis barang HKT. Kantor Pengawasan dan Pelayanan Bea dan Cukai Tipe Madya Cukai Malang sudah melayani pendaftaran IMEI atas jenis barang impor HKT di Kota Malang. Pendaftaran IMEI sudah berjalan sesuai dengan prosedur yang di tetapkan. Upaya yang dilakukan oleh Kantor Pengawasan dan Pelayanan Bea dan Cukai Kota Malang dalam menanggulangi penyelundupan yaitu melakukan pemeriksaan dengan teliti dalam bentuk pemeriksaan fisik dan pemeriksaan dokumen serta memastikan semua pergerakan barang yang berada di kantor dapat berjalan sesuai dengan peraturan dan prosedur kepabeanan yang sudah ditetapkan.

English Abstract

The government applies regulations regarding the control of IMEI (International Mobile Equipment Identity). This is done to eradicate the illegal circulation of HKT (Handphone, Handheld Computers and Tablets) because it has caused losses to the state. People who buy types of HKT goods are required to register IMEI so that cellular operators are not blocked by the government. The objectives of this research are: (1) Identify and analyze the need to register IMEI, (2) Identify and analyze the IMEI registration process or procedure, (3) Identify and analyze the efforts made by KPPBC TMC Malang to reduce smuggling of imported goods for HKT goods. The results of this study provide the fact that the regulations related to IMEI registration, the government wants to protect the public and consumers of the types of HKT goods in buying and using legal devices and to provide legal certainty to operators in connecting telecommunication networks for types of HKT goods. Customs and Excise Supervision and Service Office Type Madya Cukai Malang has served IMEI registration for HKT imported goods in Malang City. IMEI registration is already running according to the established procedure. Efforts made by the Malang City Customs and Excise Supervision and Service Office in tackling smuggling are conducting thorough checks in the form of physical examinations and document checks and ensuring that all movements of goods in the office can run in accordance with established customs regulations and procedures.
